Do anyone notice the "We will comply by November" story? Everytime there's a big change its on the 1st of November.

Can someone check to see if this doesn't coincide with Telkom's financial year end? Because like the article said, its probably a delay tactic to ensure profit doesn't look bad on their books

AcidRaZor the person from Icasa who phoned me tried to give me an explanation over the phone about my complaints and he also said that Telkom are not yet able to distinguish between local and international traffic. He started saying something like by November they will be complying, but I cut him off and told him that I don't believe that story as Telkom had no problem distinguishing before we had the hard cap, and that IS are also able to clearly differentiate between the two. I told him that I do not want to be told over the phone, I want to be told in black and white so that I have a copy of the excuses. And so he escalated it to Telkom and gave me a formal complaint number. Now to wait and see.

ICASA slapping a hefty fine unto Telkom would be a welcome sight. Though I don't even know if they are legally entitled to such an action (what, being the little ankle biter in the industry they are supposed to be governing). /sarcasm

I seriously wonder, that when a "corporate citizen" does not act lawfully and in compliance with a law that has been passed a year or so ago that there are virtually no "corporate cops" rushing to beat down the door of theirs?

I know if I ever skip "compliance" with any of my ICT bills, I'll be getting phone calls and emails within days from said "corporate citizens" and probably legal threats pretty soon after.

In Theory: Lower Prices, less shaping, more Cap [if no cap at all. well atleast make national uncapped], no resets, faster base speeds [512k is considerd a minimum], free local calls, no more push down one price push up another... and many more that come to mind

In Practice:: Nothing....

The SA government wont be there any longer as SITA is switching to Neotel, lets just hope that this is the begining of the End of Telkoms reign and the start of cheaper better sevices. :)

Lol with ICASA its more like Telkom are in the pre-warmed comfy chair rather than the hot seat. Still I'm holding thumbs to see what ICASA can do with our pathetic ADSL regulations.

Telkom should STFU and comply with the rules!!! Its not like they are going bankrupt or anything!!! It makes my blood boil to think that they are charging us for local BW!! Local BW doesnt cost them 1c!!!!! They are just greedy!

My guess is Telkom is delaying until the launch of Neotel's internet services so they can then say they don't need to comply because Neotel doesn't comply.
Won't know how ICASA will handle this argument since Neotel is never going to offer ADSL.

While I still believe that !CASA is generally and hugely incompetent, rpm did explain various aspects of !CASA's CCC to me last night, specifically that if we all submit [ADSL Regs non-compliance] complaints to !CASA's CCC, which will enact the max 90 days for a ruling per complaint, then !CASA's CCC will have to recognise the seriousness of Telkodemonopolies' non-compliance with the ADSL Regs.

I'm fairly sure that a large volume of complaints will also force !CASA to iron out the ambiguities from an implementation point of view...

There is a tunnel, and we all [ADSL customers] have to collectively switch on the light at the other end of the tunnel by submitting those complaints.

Maybe one of MyAdsl's tame Ambulance Chasers (*cough*dominic*cough*) should make a form or something that adress all the issue in a clear concise way. With added legal mumbojumbo etc and then we all can just fill in our names and stuff and send it off to IvyCasa

I'm certain there's a lot of people reading this forum which wants to send a complaint off but just dont know how to write it

What authority does the CCC have?
What penalties can they legally impose on a company that fails to play by the rules?
ICASA themselves had very limited options available to it, how does a division of ICASA, the CCC, differ from this?
Do they have teeth?


And in other news, have a look what happened to BA today.

It seems !CASA's CCC can impose fines per complaint received against Telkodemonopolies for non-compliance with the ADSL Regs - even though no specific fines are mentioned in the ADSL Regs in their current form.

Hopefully one day !CASA will sort out its ADSL Regs and large daily non-compliance fines [ZAR1m+] will be added to the new ADSL Regs - I can & do dream...
