In addition, he said that the debt agency would be attaching a recurring amount of R26 on the first of every month should non-payment continue.

Isn;t there a law that prevents interest being more than the original amount?

One of the ways that they have upped the ante is by contacting late-payers at their place of work.
Ooh contacting me at work, I'm quaking in my boots. The answer will still be f-off...

Are they even allowed to charge interest if you haven't entered into a credit agreement?

Nope... and this is the tricky part for the SABC, this is not a debt so their debt collectors can do fsck all to you...

Not sure whether in duplum applies, however because the license fees are applicable each year, not sure whether it would be compounding the interest of the entire outstanding amount.

That said logic tells me that if the license fee is R275.00 the maximin is R550.00 they may request for that particular year adding additional fees is not only illegal, it's fraud. What they may do in the event of a judgment is interest may be charged on the interest part only they may not attach additional fees over and above the initial amount.

They may include interest and fees but only up to double the amount then they may not ask a cent more period, if they do it is illegal and is fraud.

In Duplum can't apply since its not a credit agreement unfortunately...

BUT the only way they can get to the money really is via a judgement, but its not worth their while because it would cost many multiples of what the person owes which is by and large why nobody has been taken to court over this yet as far as I know.

Hmm.. interesting. Wonder if they did some research...

You get charged a penalty for failure to renew your license do they also charge interest there, because it is essentially the same type of fee, considering the fee type is the same, in duplum applies as well

As you can see in duplum applies here as well, in duplum is common law and isn't directly applicable to credit agreements only.....

They are free to ask for a cost order, which will end up in the clients having to pay all legal and court fees too, which could amount to another half a million+ to your fees. The problem is, they will need to pay the initial fees to courts to start the process though.

They can ask for a cost order.. they more than likely wouldn't get it.

They should just cut off non-paying customers' TV signals... like with any other service. If they can't do that, it's their problem IMO. This is why I had hoped for encrypted DTTV signals.

I will not give any debt collector a cent, I would rather pay the debt directly, especially if it was a tv licence.
