Scathing ruling against activist fighting Amazon HQ development in Cape Town

A high court interdict granted in the Western Cape High Court earlier this year that stopped development of the R4.6-billion River Club development, has been rescinded. This was because it was obtained “through fraud”.

Judges Elizabeth Baartman, Hayley Slingers and James Lekhuleni ruled on Tuesday that Tauriq Jenkins, who purported to act on behalf of the indigenous Goringhaicona Khoi Khoin Indigenous Traditional Council (GKKITC) in the interdict application which was decided by Deputy Judge President Patricia Goliath, “was determined to stop the development at all costs”.

He should be sued for concocting such an outrageous story. But the court is also derelict for not properly investigating the claims to check they were not spurious
All the courts are making the mistake of consulting 3rd parties about the development of a piece of private property.

It honestly sounds like this guy wants to obtain free land via court shenanigans.
I like how the people he's representing say "Who is that guy I never agreed to this"

Wrong. The court does not need to investigate anything. It is not part of a magistrate or judge's job description. A judge is simply an objective person sitting hearing and looking at the facts presented by both parties, the state and the defense. Based on what is presented to them, they can make a finding on guilt. After that, use their powers to assign an appropriate sentence.

It was the duty of the prosecutor and state to ensure the claims were investigated and either proved or disproved. If the prosecutor accepted the claims, this is what was presented to court and accepted at the time.
