The fine has to be presented to you within 30 days of it being taken, as Hemi said :p

Lol, then they are shlt out of luck. I have not signed for any of them in the post (I have received three in the last 7 months, all under R300).

Actually it will still be up to you to prove the above.... because the fine won't just magically disappear.

Would the proof not be: "erm your honour, if they will be so kind as to prove that I have received the fines in the window allowed I will disprove it?" :wtf:

What about those parking fines that they stick to your window? Do they need a photo taken for evidence? Is there any way to dispute them?

As far as things getting lost in the post, it's impossible for them to prove that you received the first notice in the post within 30 days, so they most likely just have to prove that they sent out the first notice within 30 days, and I imagine they keep records of all of those.

If you ignore the first and second notifications they may choose to summon you, or send you a final warning. These will be via registered post.

As far as I know that's how it works. I don't think you can really appeal the first notification unless you have the fine and it was only printed over 30 days after the fine.

Well I apparently have 8 fines..all from last year. Never recieved one. Found out when I was stopped yesterday by Metro. Haven't signed for any registered mail either and I haven't been summoned so what can I do here?

Got stopped by Metro on my way home and when they checked my ID no.. got a print out with said number of tickets and their amounts. Looking at R4k at the moment

You can read the GUIDELINES FOR PROSECUTION WITH REGARD TO SPEED AND TRAFFIC LIGHT PROSECUTIONS here. It's currently valid, although I'm not sure how the AARTO in gauteng affects this.

This guide does not mention being trapped by a moving vehicle. The fact that Gareth Cliff was pinged by a following cop car was repeatedly aired on TV. Where are the guidelines for that procedure?

It's a new process.

Basically it will be down to this:

The moving vehicle will have to be certified to be accurate wrt speed (probably using gps?)
There will be a period of time during which the speed-measurement will be done, probably testing it over a period of time, say 5 seconds (to instead of measuring one speed, to take an average speed over that time).
#2 will ensure that the vehicle is correctly captured.

The system was developed overseas (where it's been in use for some time now) so that would probably be the procedure.

Sorry, I don't have any information relating to this. I've searched around on other local forums and it doesn't seem like anyone is very sure.
Froot's idea sounds feasible, but I don't know of any legal requirements.

The problem is that the moving vehicle trapping is new... so it will take some time for the procedures and guides and all of that to filter down.

Shouldnt the procedures be in place before something like this gets implemented?
