Wow, FPB is really on a mission. Consider I can download porn, does that mean my ISP is registered as a porn distributor?

IANAL and I haven't pursued the relevant statute but I the argument that a broadcaster complying with the relevant broadcasting paradigms is "distributing" pornographic material has a particular odor of bovine excrement.

Applying the construct of "distributor" to the broadcasting space would necessitate that Sentech be licensed by the FPB.

I suspect that one way to make the FPB's life difficult would be for every person considering torrenting pornographic material for which there is a copyright release (samples and IIRC at least one studio is releasing some material) to flood the FPB with applications for a distributors licence. I have no idea what there fees are (which could unfortunately be high) but I doubt they would have the capacity to process 100 or so internet users applications and I suspect there will be people who don't download porn who'd be prepared to defend the principle.

As much I execrate pornography, I also oppose the State's meddling in these matters. The State exceeds its natural powers when it requires citizens to register, get licensed, obtain permits, and so on.

Keep pornography away, I say. But even more earnestly, we should keep the State away from gratuitously intruding into people's lives when no crime has been committed.
