Hi Guys
So I am a new trustee at my building and I recently just pushed for the eviction of one of the tenants who has been threatening violence to some of the people in the building(he is on good terms with me).I was successful and he was served with a 30 day eviction notice from his landlord. He has still got 28 days left before eviction comes in to effect.
So yesterday he confronts me at the building and says he knows it was me who orchestrated his eviction.
I deny it say that it was an anonymous complaint that caused it.
He then goes on to say that our chairperson had come to him and told that it was me and then had asked him to get some photo's of some new plumbing I had done to my unit.(I am in a small war with this chairperson whose units are constantly leaking water and with only a single water meter its costing everyone )

Anyway my question is.
Should this kind of information not be confidential. Can the chairperson really just go and tell someone about my work as a trustee. Can I take any action against this chairperson maybe for breach of privacy/confidentiality or something?

Thank you

There is no proof from him except he did, she said that anyone told them anything. Just say that bc matters are confidential to the bc and you can't comment on anything said in trustee engagements. An owner can ask for particulars, not a tenant.

In other words, disengage.

Tell violent former tenant that it was actually the chairperson who wanted him evicted, but chairperson is not man enough to tell him to his face.
He is not a former tenant yet eviction order only came in the day before.Chairperson is not man enough as its a woman haha.

How did you push for eviction, did you table it at the trustee's meeting?

I don't think you can take action, but what you should do is call a meeting or send an email to the trustees and chairperson telling them you're not at all happy with such decisions being pinned on you. You might've pushed for it, but you collectively made the decision to evict, and any pointing the finger at you is highly unprofessional and personally unfair.

We evicted a tenant in 2015 for overcrowding (17 people in a 3 bedroom flat) and he set the flat on fire by filling the basin with turps and throwing in a match

He was given a suspended sentence and the repairs to the building came to R4.4m. The flat and two above were uninhabitable for 2 months

I was one of the trustees who voted for eviction and was asked to resign, along with the chairman and two other trustees. They now employ a professional trustee which costs R9k a month

Why were you asked to resign?

It was said that the overcrowding problem should have been handled differently. There had been 20 written complaints about this flat, four residents were mugged in the lift by people from the flat

The owner was a Zimbabwe priest who did not live there and would call every Friday to collect the “rent”. He maintained he had no control over who visited the flat. His brother was the one who set the flat on fire. He also keyed 3 cars in the car-park and threw a TV from the 4th floor balcony

send an email to the chairperson saying eviction guy came to you to tell you that she named you, but Mr Eviction said he knows it was chairperson and will get whats coming to her, say you know the chairperson would never have done this and you just warning her to be aware this guy is trying to get in your head. also anonymously deliver a horses head (or dead flowers) to her with a ominous warning dont threaten her put right but make it ambiguous like you will get all you deserve .
and let her paranoia get the better of her

Also tell eviction guy you tried to fight for him but you know how the chairperson is she is probably afraid of him so just saying its you.

Oh i see you worked your way into becoming a trustee !

He could be testing the waters by accusing all the trustees in turn. Don't admit it.

No was done via Email.A complaint came in to the building management which was then sent to us trustees. I agreed with the complainant and added my own knowledge of offenses onto it which were substantial.

All matters discussed and agreed to by trustees can and must be disclosed to the body corporate, there is no confidentiality.
Only on request. and as someone else said this is a tenant not a owner and he was approached by the chairperson with the intent to cause me distress.
