TV installation guys reversed into my bike

Hi All,

Last weekend started off well when guys from early bird services reversed into my bike. I live in a complex and they were picking up a TV from a resident.

I contacted their boss who said that I must get a quote from Honda and he will make sure it gets paid. I called him today with the lovely quote of R8000 odd and he gave me a long story of how the driver has to pay it, and he needs to borrow money from his dad. bla bla bla. Long story short it seems like this guy is going to avoid paying me.

The bike is insured. So I said to him that I am going to contact my insurance so that they can fight him for the money instead. He said that he doesn't have insurance on the vehicle so he doesn't think that is going to work.

What should I do? Go to the cop shop and fill in an accident report and report it to the insurance?

Claim from your insurance and make all of this his problem. It's not your problem, so don't make it yours :p

The only reason I didn't want to claim was because of insurance premiums going up?


I think less than 12k you can go through small claims, if you have proof that it was your fault it should be a rather simple process.

I went through the insurance for my claim, the other driver had no license, no insurance and car was not registered, three years later my premiums are still through the roof and the insurance can't track the idiot down.

Question is will they go up more than your R8000 and sanity in small claims court? You might come right, or you might not get a cent?

It's doubtful the driver has to pay for accidents on their wages. Traffic tickets, yes/maybe.

If the insurance company can't get to the guy what makes you think small claims will work? If he doesn't have R8k the courts are just going to order him to pay x amount over x length of time anyway.

I would have rather gotten X over X days then nothing over X days, I was able to find the person, gave the insurance the details of where to find him and they still got nothing done.

My damage was for R22k though, also my premiums when up by just over R300 for my policy so it has cost me quite a bit over the last three years.

But, that's their problem. They pay for your repairs and try recover it from the kippy who damaged your vehicle. The alternative is paying out of your own pocket and trying to collect it yourself from some guy who in all likelihood ain't going to pay you jack. It kind of defeats the whole point of having insurance in the first place.

You have to report the accident to the police that's separate from the claim so just get that done.


Next you can decide to claim through the small claims court(will take up your time) or to involve your insurance(will cost you money) or just leave it.

I think you are missing what I said, they pushed my premiums up by over R300 a month, over the last three years costing me just over R10k in premiums and I had to pay R4000 cash excess, so in total the accident has costed me R14k so far and I am still paying inflated premiums. I would have rather then just paid with my credit card, gotten a lekker discount on my repairs and gone after the guy myself, seems I would have had a better chance. But this could also be bacause the insurance was useless.

Insurance.
Same thing happened to me in my complex. Didnt have insurance but got all the details. When I called his iunsurance they said in their report it stated that I drove into the truck. ****ers didnt want to budge. Didnt have the energy to fight so left it.

Just claim from your insurance and avoid the hassle.

And where exactly the fcck did you say all that? Depending on your premiums I can't see them going up more than 10% for a single claim. So, granted, you may be paying R3k for insurance but with that sort of excess you must be getting a seriously k@k deal. I'm guessing that wasn't your first claim by a long shot. Anyway better R14k over 3 years than R8K right now. Also, why do you care if they recover the money from the guy responsible? Will, they adjust your premium if they do?

Your premium shouldn't go up as you weren't the cause of the accident.

You will however fight forever and a day to get your excess back.

Also insurance companies push you premiums up every year because well...bull****.

So do what I do and simply tell them to **** off and then get a quote elsewhere or claim that you'll be moving. Magically your rate gets reduced to less than it was the year before.

As I said in my first post my insurance premiumns went through the roof (sorry for not going into pages of detail, figured it was not needed but it appears it was as people like getting excited over here) and insurance has still not tracked the guy down so did not think of stating the obvious that they had not got the money back.

It was my first accident claim, only previous claim was for a windscreen, unfortunatly I had only been with the insurance a year so the R22k claim pushed my risk profile through the roof.
