CIVIL rights groups this weekend slammed the University of Fort Hare for firing staff under the auspices of an outdated policy document formulated during apartheid.

The 36-year-old document categorises employees according to marital status, gender, sex and race, even stipulating that black women may only be appointed to permanent positions once they are married.

South African Human Rights Commission (SAHRC) boss Tseliso Thipanyane said that by using the document the university had contravened the country’s Bill of Rights.

Freedom of Expression Institute (FXI) attorney, Simon Delaney, said: “These conditions of employment do not fit with our new Constitution.”

Examples include that black women will only be appointed to permanent positions once they are married, references to a “black state” and “non-white legislative assembly”.

Constitutional law expert, Professor Dieter Welz, who was dismissed for bringing the institution into disrepute, has appealed on the grounds that his dismissal is unconstitutional because it was based on the old code. The appeal is due to be heard this week.

Margaret Irvine, a senior lecturer in education, was fired last week after refusing to attend a disciplinary hearing held under the old code.

Speaking from Johannesburg, Thipanyane said: “It is unacceptable for an institution like Fort Hare, known for producing world respected leaders, to take so long to replace a document based on apartheid legislation.
