Leaked Kavanaugh Documents From Time at White House Discuss Abortion, Affirmative Action

WASHINGTON — As a White House lawyer in the Bush administration, Judge Brett Kavanaugh challenged the accuracy of deeming the Supreme Court’s landmark Roe v. Wade abortion rights decision to be “settled law of the land,” according to a secret email obtained by The New York Times.
The email, written in March 2003, is one of thousands of documents that a lawyer for President George W. Bush turned over to the Senate Judiciary Committee about the Supreme Court nominee but deemed “committee confidential,” meaning it could not be made public or discussed by Democrats in questioning him in hearings this week. It was among several an unknown person provided to The New York Times late Wednesday.
Judge Kavanaugh was considering a draft opinion piece that supporters of one of Mr. Bush’s conservative appeals court nominees hoped they could persuade anti-abortion women to submit under their names. It stated that “it is widely accepted by legal scholars across the board that Roe v. Wade and its progeny are the settled law of the land.”
Judge Kavanaugh proposed deleting that line, writing: “I am not sure that all legal scholars refer to Roe as the settled law of the land at the Supreme Court level since Court can always overrule its precedent, and three current Justices on the Court would do so.”

Booker Releases Committee Confidential Documents Related to Yesterday’s Testimony

WASHINGTON, D.C. – U.S. Senator Cory Booker (D-NJ) today publicly released several documents previously marked Committee confidential from Supreme Court nominee Brett Kavanaugh’s time as White House Counsel under President George W. Bush.


“As I’ve been saying from the beginning, this process has been a sham,” Senator Booker said. “The fact that tens of thousands of documents revealing a Supreme Court nominee’s views on key issues were deemed Committee Confidential and not available to the public reflects the absurdity of this process. The public has a right to access documents about a Supreme Court nominee’s views on issues that are profoundly important, such as race and the law. This process has demonstrated an unprecedented level of secrecy and opaqueness that undermines the Senate’s Constitutional duty to advice and consent.”


Last month, Booker joined Senate Democrats in advocating for the full public release of the 141,000 documents related to Judge Kavanaugh’s record that had been marked Committee Confidential.


The documents Booker released today contain several emails regarding Judge Kavanaugh’s concerning views on racial profiling and affirmative action – emails that Booker referenced during his questioning of Kavanaugh last night.


In one email, with the subject line “racial profiling,” Judge Kavanaugh remarked that he “generally” favored race-neutral security measures, but thought there was an “interim question” of whether the government should use racial profiling before a supposedly race-neutral system could be developed sometime in the future.


Booker asked Judge Kavanaugh to further explain his views on these subjects during questioning yesterday, but Kavanaugh refused to answer.

Meantime, Cory Booker is at the Kavanaugh hearings to kick ass and chew gum and he’s all outta gum.

He threatened to violate rules to release mails the Repubs were hiding behind committee confidentiality, proving the GOP and ‘ol Brett were lying.

Grassley and Cronyn throw sham hissy fits to say he can’t, consequences, blah, blah, whimper.

And Booker dropped the mails anyway.


I’ll wait here for rietrot and co to tell us how Booker breaking rules to expose swampy shyte is *actually* swampy.

two senior administration officials reached out to Axios to say the author stole the words right out of their mouths.

"A lot of us [were] wishing we’d been the writer, I suspect ... I hope he [Trump] knows — maybe he does? — that there are dozens and dozens of us."

Trump seems to be consumed by paranoia.

For some time last year, Trump even carried with him a handwritten list of people suspected to be leakers undermining his agenda.

Wait, Kavanaugh lied about more things? Colour me unsurprised.


Kavanaugh testified he never received any docs that even “appeared to … have been drafted or prepared by Democratic staff.” Well, he got 8 pages of material taken VERBATIM from my files obviously written by Dem staff, LABELED “not [for] distribution”.


Brett Kavanaugh was asked in 2004 about whether he was involved in the nomination of Bill Pryor. He said “I was not involved in handling his nomination"

Newly released emails show that's not true. Asked about how Pryor's interview went, he replied "CALL ME."

No wonder Repubs don't want the other docs to come out. At least 3 different counts of perjury already uncovered.

This whole process has been absolutely shameful and corrupt to the core. But they don't care, because he'll rubber stamp all the policy decisions they like.
