Vodacom and Nokia E90 Gripe

Not two weeks ago I took out a new business contract through Vodacom (Metro store in Vodaworld) for the E90 with pay-in.

I specifically asked the sales person if the E90 they had provided was the new one (without the software issues, keyboard touching screen and scratching it when flap is closed - all these issues were to have been rectified - which is why we waited for so d@mn long to get one). He said yes, it was the new one as the stock had come in not two days before.

You guessed it, the f@ckers gave me an old one! WTF????

What recourse do I have against Vodacom/Nokia for clearly providing a phone that was PULLED by Nokia to sort these issues out, but still sold on to the public?

Its sales, you fell for it.
Did you open the box and have a look for yourself? You should have.
Is it with 7 days of purchase?

Anyway I suggest you go back and CALMLY ask for the new one, or go to the Nokia store and ask them.

Nokia the idiots havent changed the product codes so its hard to tell from the outside of the box, which is the new one or the old one.

I only realised a few days ago when the software started acting up and light scratches started appearing on the internal screen. By then it was too late to take the phone back to fall within the 7 day return policy window.

So having to deal with Vodacare (who incidentally should change their name to Vodadon'tcare). That's the attitude I get.

I dont think the new ones are perfect either, S60 phones are problematic regardless of how new it is.
Its brand new so it falls under the manufacturers warranty so even Vodacare are not touching your phone, they handing it over to Nokia.
