Waspa fines bulk SMS sender R15,000 for spam

So let me understand this. Truworths spams and the gateway supplier gets fined?

Being in a similar marketing field, it is quite impossible to control what and who clients sent to. Yes, filters can be added to trigger certain sms and emails to be approved first, however, in most cases the supplier will only be made aware of the clients spam once the complaints have rolled in.

Well, Truworths is not a WASPA member and shouldn't be, but the solutions are relatively straight forward:

Your contracts need to pass on the cost of WASPA fines for spamming onto the client involved. Or you must assume there will be a number of spams and build it into your costing. Or you must just absorb the fine if not choosing to do one of the afore mentioned..

Easy, when the gateway supplier receive complaints/fines, they pass it on to the client?!

Say you were standing still at a traffic light, and behind you is a vehicle, and then some guy crash into the guy behind you, that cause the guy behind you, to crash into you, then you don't sue the guy that caused the accident, you get your money form the guy behind you (via insurance), because he crashed into you... not the 3rd guy.

The person receiving the sms didn't ask for it, and the person doesn't know who sent the sms, but it came from company xyz's sms gateway. So company XYZ is liable. If they have the proper agreement in place with their clients, they can get their money back.
 
i'm gonna report TV License, their spam this past week has been ridiculous - and no, i'm not a tv license subscriber.

Great, think I will report all my spam as well, where do we report it?

Ok so now we need to send all the numbers we receive spam to WASPA.
