It’s emerged the ANC in the Western Cape has missed the deadline to register candidates for 12 by-elections in the province.

A record 27 by-elections are taking place in the province on December 10th.

That's to fill seats in various municipalities left vacant by resignations of councilors who’ve joined the Congress of the People.

Just a few weeks ago, the ANC was adamant it would win back 8 ward seats left vacant in the city of Cape Town.

But the Independent Electoral Commission reveals the party failed to make yesterday's deadline of 5pm, automatically excluding them from the race for council seats in the Mother City.

The IEC’s in the Western Cape's Courtney Sampson says it’s always unfortunate if a party doesn't make a deadline.

The ANC also failed to register candidates in the Cederberg municipality, where 4 seats are being contested.

Words for once fail me.

ANC takes IEC to court 12/1/2008 7:58:57 AM
Some opposition parties in the Western Cape say that they will be keeping a watchful eye on the ANC’s court application against the Independent Electoral commission.

On Friday the ruling party took the IEC to court following the ANC’s failure to register 12 of its candidates for the provincial by-elections next week.

Opposition is saying that the ruling party should not expect special treatment and a total of 27 vacancies have been created in the Western Cape by officials’ departure from ANC to COPE.

Is the ANC is taking this to court on the grounds of acceptable utter incompetence ?

IEC gives ANC three days' grace

After an agreement with the ANC, the Independent Electoral Commission (IEC) has postponed for three days its deadline to issue a certified list of candidates to contest next week's by-elections.

The agreement, made an order of the court on the weekend, resulted from the ANC's legal action against the IEC after the party missed Thursday's 5pm deadline to register 12 of its 27 nominees for by-elections in the Western Cape.

The IEC will file answering papers on Monday, the ANC will file the organisation's reply on Tuesday and the Electoral Court will hear the matter on Wednesday, as well as determine who should shoulder the legal costs, according to Saturday's court order.

Neither IEC provincial head Courtney Sampson nor ANC deputy provincial secretary Max Ozinsky would be drawn on the merits of the case, but Ozinsky said his party was convinced it had met all the criteria to register the 12 candidates.

Sampson said every election had a timetable. Thursday was the deadline by which parties had to submit nominees.

Let me guess.... the Post Office lost their applications ?

Look, it's really simple. Either they met the Thursday 25/11 @ 5pm cutoff - or they didn't. What "merits" could the court case possibly have?

TheREV : Its quite simple... The ANC is suing the IEC because they're not incompetent and how could an incompetent party that is still struggling against counter-revolutionaries etc be able to meet a ridiculous deadline that they only knew about say a year ago?

According to the court papers, provincial secretary Sipho Kroma said the nomination forms had to be accompanied by a bank-guaranteed cheque for the prescribed amount, a certified copy of the candidate's ID, written authorisation of the nomination and the candidate's acceptance of the nomination.

He said there were eight ANC candidates in the city and that a bookkeeper employed at the ANC provincial office in Cape Town contacted the Athlone branch of FNB at 2pm on November 27 to arrange bank-guaranteed cheques for the candidates who were to contest the by-elections.

The bookkeeper also decided to requisition bank guaranteed cheques from the Cape Town branch as a precautionary measure.

But there were administrative delays at both banks and the cheques were eventually issued in Cape Town at 4.10pm.

The eight nomination forms were delivered to the IEC offices in Bellville at 4.30pm and commission officials were informed that the cheques were on the way. The cheques arrived at 5.10pm.

But the officials declined to accept the nomination forms because the cut-off time was 5pm.

Kroma said nomination forms for the Cederberg by-election were not accepted because they were not accompanied by copies of the candidates' IDs.

According to Kroma, the ID copies were not attached to the forms because the candidates were only selected at a late stage due to "political movement and instability as a result of the recent formulation of Cope".

The ANC's West Coast regional secretary arranged for copies of the candidates' IDs to be faxed, but commission officials refused to accept faxed copies.

At that stage, the cut-off time had already passed.

Now the ANC has taken the matter to court in a bid to have the nomination forms accepted.

And its takes how long to get a certified copy of an ID. Did they pick these candidates at 4.45pm?

But heaven forbid you miss the cutoff time for a government tender. You will be shown the door, unfortunately the ANC let this one hit them on the way out! :D

A senior ANC official in the province told the Mail & Guardian: "We [the ANC] were simply too slapgat and arrogant to register our candidates with the IEC by the cut-off date.

"Our officials sauntered over to the IEC's offices and said they were stuck in traffic and didn't have all the necessary papers because they thought the IEC will bend the rules for them."

Cape Town's newspapers have reported that the ANC secretary general, Gwede Mantashe, came down like a ton of bricks on provincial leader Mcebisi Skwatsha and provincial secretary Sipho Kroma for failing to take the registration process seriously.

The Electoral Court is expected to hand down judgement today in the court battle between the Independent Electoral Commission and the African National Congress.

The ruling party wants the decision to exclude it from the 12 by-elections in the City of Cape Town and Cederburg Municipality overturned.

This comes after the ANC missed the cut-off date for the handing in of nomination forms for their candidates in these two councils.

Political analyst Amanda Gouws said the case would set a precedent because, even if they were the ruling party, the ANC could not simply break the rules.

“I think it is an important case, depending on the court will rule of course, it will be a precedent. But I’m not sure the court will rule in the favour of the ANC,” said Gouws.

No confirmation yet, but reports say the Court has upheld the IEC decision to bar the ANC from taking part.
