The author skipped the lesson at uni on 'impossibilia nulla obligatio est'. A principle that goes to the core of any contract. If it is or becomes objectively impossible to perform in terms of a contract, both parties are relieved from their obligations in terms thereof.

In short, Force Majeure. These attorneys are not bright and I would give them a skip until they build up some real law experience. All these labour laws means nothing if there is no enforceable agreement. Just ask Transnet.
