The supplier refuse to refund a deposit after not being able to deliver the product on time and also the product being of a poor design when he finally managed to get it made.

What to do:

1) Kiss your deposit goodbye; the supplier used it to make the product*
2) Discuss and approve the design before the deposit is paid, get this in writing.
3) Have a contract that specifies penalties for non-delivery/late delivery.
4) Choose your supplier more carefully next time.

* depending on the amount & circumstances you may be lucky in the small claims court. But from the limited info you provided and the fact that you even had to ask... you are screwed.
