When to expect tenants to pay rent again.

Have a friend who had similar issue. Tenants didn't pay and refused to leave.

Eventually She conceived a plan. She tells them, fine, it is ok, you can stay, but make some space in the house because she's arranged for several Nigerians to move in to cover costs.

They evacuated soon thereafter.
We all have that "I have a friend" story told at the braai.

So, interesting times ahead ..........

I am headed back to SA ..... during COVID ....... cant come back to the US till we get our SA strain sorted and I can exit SA, so will have work remotely for a few months from SA ........... Just because snotkop in my house is hiding there, not paying rent, has altered the structure, and will not move an inch.

According to him, its HIS house and the SAPS can do nothing, SA lawyers ...... well, waiting on the next teams meeting ..... and the next one ......... its a fekkup!!

Dont pay your utility bills...if its prepaid power then you have a bad time but the municipality can turn off the water im sure.

So, COVID came along.
Tenant in my house couldn't pay rent from March.
I let it go, and paid the rates out of my pocket. I continue to do so.

The guy couldn't afford to eat, so I paid just over ZAR10000 on groceries in April. (It was a crazy time during a lockdown et al).
The rent, well it just never got paid. But ....... COVID, and someone had to take a knock.
Its now November, and still no sign of the chap paying rent.

Is this normal in SA at the moment, or are rentals being paid again?
Banks have Covid relief solutions to assist people.

Least you can work remotely for a few months while things hopefully sort themselves out.

Stories like yours are pretty much why I have totally backed out of my plans. Of buying property to let in this country, risk has become too high in my opinion.

Absolutely ........... the risk isnt worth the effort.

I just hope this doesnt damage my plans completely.
The tw@t in the house is just oblivious to the cost, emotional, financial and psychological.

At this point, I am considering getting my old gardener and some mates to move in as the NEW tenants.

I am moving in ........... there is no way I am paying to stay in a hotel while snotkop lives my house.

I thought evictions are illegal during lockdown periods?
I filed a motion to evict in SA from the US. The high court in SA set it down for March 5th, subject to the tenant appearing in court and that I have arranged alternative digs ............ :(

Cost to me in legal fees - ZAR32 000 so far.

So, evictions are allowed, but difficult.

this, just stop paying the bill, to speed up the process, go to the municipality and inform them you can no longer afford paying the bill, the next day it will most likely be cut off

the problem you have is that you did not prepare for an eviction, insurance for evictions are cheap, R150pm

This is just a messed up situation. No, do not skip your municipal payments and have the water and lights switched off. He will immediately obtain a spoilation order against you and in fact it is illegal to do so. The quicker you can get the court dealings behind you and have the fu***er evicted, the better. Unfortunately, this process may still cost you in excess of R100k. I still expect this guy to put up a big fight in court too for compensation for the changes he made to the structure.

I hope that there is no legal point for him to lay claim to your property and wins his case in court. I suspect that you may have waited too long to take actions. I do know that there is something in the law where if a tennant stays for some years without paying and making changes to the property without any claims for rent or objection, they can lay claim and a court may order the transfer of ownership to them. I am not sure what the requirements for this is though, but almost think the time period is too short for them to do this.

its illegal to instruct the municipality to cut the services, its another thing when you tell them you can't afford to pay, and by his own admission, he is struggling to finance the tenant further, thus he cannot afford to pay the bill

True, but this will leave open a whole cans of worms. He may still get a spoilation order based on the fact that the utilities were paid monthly. Upon hearing the case in court, before the order is made permanent, he may need to prove he can't afford it any longer. May require proof that income from source has stopped, bank statements and more. Still not advisable to go this route.

I've been through this before many years ago, it was advice received by the counsel that I paid to evict my tenant at the time.
