Who owns the fibre/infrastructure?

A network rolled out fibre in a complex in our area. Apparently no agreement/contract was ever signed by the trustees to give permission or clarity on ownership of the infrastructure. Only verbal permission was granted and the project was completed and is now live.

If no written agreement is in place, does the network company have exclusive use of the infrastructure, do they have the right to access to internal network at all /any time? Are they allowed to recover /repair in a way that would require structural changes in the complex without permission ( trenching etc.)

Rather contact the company and ask them if they are subcontractors or not. Then speak to the company that mandated them and ask them on what basis they did it. With multiple trustees with sometimes conflicting agendas, you might not always get the truth.

I think this fibre gold rush may start getting really nasty soon.

My mom owns a flat in Beach Rd, Strand. A company that rents the roof ran fibre into the building years ago. At the same time, they ran fibre to any flats that wanted it. She's been on fibre for the past eight years. Happy days. Up until last week, I'd not had a single call from her about her internet in years.

That ISP has a contract with the trustees to rent the roof and provide FTTH in the building, that was renewed last year. I know this as I had to visit them last week to see for myself, to try and calm my mom down. More about that later.

Then last year two other networks started rolling out fibre in Beach Rd.

It seems that that the trustees have conflicting agendas. Now it appears that one trustee signed an agreement with the one company while a second trustee signed an agreement with the other company. One of those is an "exclusive" agreement.

Next thing, third party sales people are telling my mom that her fibre must come out and that she has to use one of the other companies. Needless to say, she's not happy.

I would not be surprised if one of the new companies offered a trustee "free internet for life" through one of their sister companies to sign the exclusivity agreement.

may not do that, contravention of competition act. i dont have the details with me.

they can all install their fibre to the building and the tenants can choose, they tried it at my place, we have 3 providers. told 1 to get knotted exclusively, now nobody is using them because they insist on at least 6 signups before activating a single apartment, while the other 2 do individual sign ups.

and yes, there are incentives, ive been offered them too, im a trustee. tsek.

unless the original provider is stopping services to that building there should be no reason for her to change.

Yes if they didn't do it on commission the infrastructure is theirs. Find out who the company is, if it's one of the well known ones.
