Woman apologises to Tumi Sole over ‘false and defamatory allegations’ of rape in Durban hotel

A woman who accused lawyer and social media activist Tumi Sole of raping her in a Durban hotel room and giving her HIV has issued a public apology, calling her claims false and defamatory.

Tinah Mashiloane issued the apology on social media following allegations that emerged as part of the outing of alleged sex offenders on Twitter as part of the #AmINext movement following high-profile acts of violence against women in recent weeks.

"The allegations following on several other messages that I had sent to [Sole] in which I had been making threats against him and his family since August 1, 2019. I also created a fake account under Lerato Motsoeneng [@leratoMotsoene8] and repeated these false and defamatory allegations that I made against Mr Sole," her apology read.

She received a lawyer's letter on September 2, and initially denied she had been the one who posted the allegations.

"In this regard, this letter serves as my official admission that I was the one who posted the false and defamatory allegations on @HelpSurvivers2, and I would like to take this opportunity to profusely apologise to Mr Tumi Sole, his entire family, #CountryDuty, the directors of #CountryDuty and the members and supporters of #CountryDuty for the pain and suffering that I have caused everyone.

"I was never at a Durban hotel with [Sole] nor was I ever raped by him."

She was probably paid off to withdraw her accusations

Why do you say that? Tumi did exactly what you'd expect an innocent accused person to do - go legal. He looked 100% confident from the onset. Compare that to, for example, Danny Jordaan.

Of course I appreciate that we can never really know what happened so there's an element of speculation to any view in this matter.

Well if there is any justice in this country her public statement that she lied should be used immediately in court to "lock her up".

Pretty sure we have not dropped "false allegations" from criminal offenses yet.

In a sense, Tumi is not the only victim of her actions. Every rape victim is. This incident will be pointed to when the next woman comes forward with a less-than-watertight case. Even though false accusations are statistically not significant, anecdotes like this get used to create public mistrust.

Thats not how the law works.

If you report a false rape case and the police investigate it and it turns out to be a lie then it turns into the state vs the false accuser.

This is the case in any country with even partial laws, look at Jussie Smollett case as a good example.

Same goes for any case where you phone the police as a joke for a bomb threat. Just cause you go on twitter and say sorry it was a joke does not mean you will not be criminally charged by the state.

That depends on whether she opened a case against him with saps. If she did and it turns out she lied about everything then the state should prosecute her for several charges. If she did not report a case to saps it's libel and a civil matter in which case Tumi could open a civil case against her for libel and a few other things.

It looks like she didn't. Many people often assume what happens online stays online. You just have to look at the amount of racism on facebook and twitter.

No idea, if she didn't he should sue her and clear his name properly else you get people like c4cat saying he paid her off and the rumours carry on.
