This is complete and utter crap! I'm a one-man show that's developed my own EPP software and registered as a registrar about +10 years ago. I've been hosting domains for the last 20 years. These new "rules" will put me out of business! Government is supposed to help the small business, not close us down! FFS!

I feel for you. It is not nice seeing these new laws popping up all over the place and then having to close down your business. Unfortunately, this is the aim of the ANC. They are working towards nationalizing all businesses in South Africa. But, in the process they are killing off the economy. In any event, as things stand in the South African economy and business sectors, there will not be a big economy in future. It will take many hundreds of years to rebuild what the ANC has destroyed.

The Registrar shall ensure that the Regsitrants, submit the following information in relation to each Domain Name:
a) Identity document details
b) Physical address
c) etc
What ZADNA have failed to explain is how registrars must submit this data to the registry. From a technical perspective how are we supposed to submit this data via EPP?

What if the data subject refuses to disclose this data, or the registrant is not a South African, or not in possession of such document?
What about EU subjects?

What plans are in place to protect subjects that are part of EU where GDPR exists?

Their entire proposed gazette stinks of copy paste, thumb sucked ideas without any logic or understanding of how the domain name industry works and the consequences of this.

It’s evident based on the manner in which they have handled or attempted to handle the new registry contract that they have no cooking clue about this industry.

All they see is more money and more regulation which they cannot enforce.

Many valid questions and points to raise and we need to and will stand as a collective and try fight this on behalf of the industry and the registrants that we service.

  • Registrars must provide broad-based black economic empowerment (BBBEE) information with their licence application — specifically details of BEE ownership.

Just get a .com address. Unless you have a very specific requirement for which a za domain is needed, I wouldn't bother.

RICA = Regulation of Interception of Communications and Provision of Communication- Related Information Act

What about our right to privacy?
Why is government so interested in spying on citizens?

Other countries don't require this so don't use the excuses "think of the children" or "War against Terror" as that is not logical - (seems child issues/terror only a problem in za domains)

Well their loss no web developer will go trough that process just to get a domain. The hell with .co.za

They’ve been introducing more rules outside South Africa too, and increasing the prices. Even so I allowed all my za domains to expire a while back and just kept the non-za ones, because I saw no point in keeping them or having to deal with the South African registrar.

It’s appropriate that the film and publications board’s idiocy is mentioned in the same article. Another piece of idiotic legislation from people too dumb to walk and chew at the same time.

But then the ANC and EFF wouldn’t be allowed to ever speak in public or publish anything. Both are guilty of spreading misinformation and regularly engage in hate speech.

The section to include a network diagram and proof of security and number of servers.... Don't the realise that many / most will use cloud services with google / aws / etc... How would I provide that network diagram in a 3x1cm block???

Just put "servers" and "Internet connection"... It's not like anyone will actually understand the stuff.

Getting a .co.za domain helps to drive local traffic. For a business whether a startup or an established business it is best to secure your brand identity by ensuring your register your business domain names both local or TLDs

Uh, no thanks. .com, .org and .net is all you need. co.za is a risk and a potential bad investment as long as regulation and nationalization occurs on the registry.
