Yello Hummer No More

MTN recently launched an Advertising Standards Authority of South Africa (ASA) complaint against Nando’s “Yello’ HUMMER” advertising campaign, saying that it exploits its advertising goodwill and is an imitation of the cellular company’s advertising.

The ASA has subsequently ruled against Nandos’s “Yello Hummer” advertising campaign, and the company now has to withdraw its print advertisement, in-store promotional material as well as the radio commercial.

“Nando’s has deliberately copied MTN’s advertising in a manner that is unacceptable. The ‘Yello Hummer’ advertising campaign is a clear imitation of MTN’s ‘Yello Summer’ past summer campaign. Nando’s has copied everything from the wording, font, colour scheme and the design layout,” the ASA said.

“In terms of the code of advertising practice, an advertiser should not copy an existing advertisement in a manner that is recognisable which may result in the likely loss of potential advertising value,” the ASA concluded.
