Is Telkom breaking the law?

ICASA published its ADSL Regulations in August 2006, calling for – amoung other things – the installation of an ADSL service within 30 working days.

Recent reports emerged that Telkom informs new ADSL applicants that their lines will be installed within 6 to 8 weeks. This information was tested by calling Telkom and requesting a new ADSL installation, and Telkom did indeed give an install date of between 6 and 8 weeks.

The installation date given by Telkom translates into 30 to 40 working days – clearly in contravention of ICASA’s ADSL Regulations.

This may however not be the only regulation which Telkom is in contravention of. The ADSL Regulations prohibit port prioritization – something which is still part and parcel of Telkom’s standard ADSL offering.

Consumers have lodged complaints regarding these issues with ICASA, but up to now not much has come of these complaints.

Telkom did not respond to requests for feedback regarding this issue.
