Telkom uncapped and fair use limits uncertainty

DON'T USE Telkom TV screens

Telkom’s uncapped broadband advertising came under the spotlight after a complaint was lodged with the Advertising Standards Authority of South Africa (ASA).

Telkom advertised its uncapped ADSL products, and in detailing the monthly data limit it stated that there is “no limit”.

One consumer disputed this claim, arguing that Telkom’s terms and conditions clearly state that these accounts have a fair usage policy.

The complainant argued that the advertisement is misleading because it is not unlimited as implied by “No Limit”, nor is it “Uncapped” as Telkom imposes certain limits that are only disclosed in the “Telkom Internet Acceptable Use Policy”.

Telkom responded saying that it has already amended the advertising which will clear up the uncertainty.

The ASA has a long standing principle not to rule on the matter if the advertiser amends or withdraws the advertisement. It therefore accepted Telkom’s response without considering the merits of the matter.
