Judgement reserved on SABC unfair dismissal dispute

The SA Broadcasting Corporation is seeking a review of a decision taken by the Commission for Conciliation, Mediation and Arbitration (CCMA) which ruled that editor Motlenyane Diphoko’s dismissal was “substantially and procedurally unfair.”

Diphoko was dismissed over alleged wasteful and fruitless expenditure which resulted in financial loss to the broadcaster.

He was charged with authorising payments to independent contractors without validating their claims.

Diphoko was given an option to be demoted to a position of a producer as an alternative for dismissal.

However, Diphoko said he was not given an appeal hearing against the decision, and was simply fired.
