Apple says Samsung is destroying evidence

Apple has accused Samsung of intentionally destroying the evidence it was supposed to hand over to the Cupertino-based company, following a court order.

Apple has filed a motion in the Northern District of California which refers to Samsung’s action as “spoliation” of evidence. It wants the Judge to inform the jury that Samsung acted in bad faith and failed to meet its legal duty.

Apple also said that Samsung’s action were “intentional, wilful, [and] without regard to Apple’s rights.”

A hearing on the motion is scheduled for 7 June, with Samsung’s reply to the accusations due on 15 May. Meanwhile, Samsung is seeking an extension until 29 May, and would like the hearing to be pushed back to 10 July.
