MegaUpload wants piracy charges dismissed

The United States has no jurisdiction over Hong Kong-based MegaUpload according to lawyers for the cloud-storage provider, who want charges of piracy against the company dropped.

“Megaupload does not have an office in the United States, nor has it had one previously,” according to a motion to dismiss by MegaUpload’s lawyers. “Service of a criminal summons on Megaupload is therefore impossible.”

The United States Attorney’s office has accused MegaUpload and its founder Kim DotCom of running an online piracy service that promotes sharing illegal files. DotCom denies the U.S. Attorney’s assertion, and says they oversaw a legitimate operation that allowed people to store digital content online.

Ira Rothken MegaUpload’s lead attorney said, “We told the court that the United States lacked probable cause to take down the entire site. It would have to hold the company criminally responsible for the acts of copyright infringement committed by its users. And there is no such thing as criminal secondary copyright infringement.”
