The legal battle between incoming pay-TV operators Super5Media and On Digital Media (ODM) has been delayed until next week.<\/p>\n
This is as a result of a request for postponement on behalf of Super5Media.<\/p>\n
It emerged last week that On Digital Media (ODM) had filed the interdict towards the end of 2009 in an attempt to prevent Super5Media from going forward with its commercial launch. The basis for the action was that Super5Media was awarded a broadcast licence based on Telkom Media’s submission in 2007. Other pay-TV hopefuls were forced to submit extensive documentation and were closely scrutinised by ICASA.<\/p>\n
In response Super5Media director responded that the company “will defend this action as we see it as frivolous and opportunistic and launched with an alternative agenda. Further comments will become clear once the judge has ruled.”<\/p>\n
According to ODM spokesperson Elouise Kelly Super5Media requested the postponement for unknown reasons and “as ODM we agreed to their request for a postponement.”<\/p>\n
A Super5Media spokesperson has however revealed that the request was “based on convenience by agreement between both parties based on their legal representatives’ availability”.<\/p>\n
The case will be now be heard on the 2nd of February in the South Gauteng High Court.<\/p>\n
