Graphic designer Susan Kare, known for giving the Macintosh its smile through the “Happy Mac” icon, has been called to testify in the patent case between Apple and Samsung, CNET reported<\/a><\/strong>.<\/p>\n

Samsung was found guilty of infringing Apple’s intellectual property in the iPhone six years ago. Apple has asked for over $1 billion in damages, and the court is hearing subsequent arguments.<\/p>\n

The arguments are centred around “articles of manufacture,” a legal term to describe the portions of a device covered by a patent.<\/p>\n

Samsung won a case in the US Supreme Court in 2016 which ruled that damages should be based on components and not profits from the entire phone.<\/p>\n

On trial are three design patents: Apple’s “black rounded rectangle” patent (US Patent No. D618,677<\/a>), a similar patent which shows a rectangle with rounded corners and a rim called the bezel (US Patent No. D593,087<\/a>), and one which describes a grid of colourful icons (US Patent No. D604,305<\/a>).<\/p>\n

Kare said there is no question that the icon grid patent applies to the phone in its entirety.<\/p>\n
