{"id":298704,"date":"2019-03-11T14:48:39","date_gmt":"2019-03-11T12:48:39","guid":{"rendered":"https:\/\/mybroadband.co.za\/news\/?p=298704"},"modified":"2019-03-17T22:12:53","modified_gmt":"2019-03-17T20:12:53","slug":"icasas-confusing-change-to-its-data-rollover-regulations","status":"publish","type":"post","link":"https:\/\/mybroadband.co.za\/news\/telecoms\/298704-icasas-confusing-change-to-its-data-rollover-regulations.html","title":{"rendered":"ICASA&#8217;s confusing change to its data rollover regulations"},"content":{"rendered":"<p>New user regulations from ICASA came into effect at the beginning of March, compelling mobile network operators to change how they handle data, SMS, and voice bundles.<\/p>\n<p>However, in a last-minute change to the End User and Subscriber Service Charter regulations, ICASA explicitly exempted mobile virtual network operators (MVNOs) and resellers from the new rules.<\/p>\n<p>While earlier versions of the regulations also did not apply to &#8220;licence-exempt&#8221; service providers, such as resellers, ICASA added the following wording to the Service Charter <strong><a href=\"https:\/\/mybroadband.co.za\/news\/broadcasting\/295550-icasa-amends-end-user-and-subscriber-service-charter.html\">weeks before it came into force<\/a><\/strong>:<\/p>\n<p>&#8220;These Regulations do not apply to mobile virtual network operators, resellers and Internet of Things (or machine to machines).&#8221;<\/p>\n<p>This means that while the likes of Vodacom, MTN, Cell C, and Telkom are required to allow subscribers to turn off out-of-bundle (OOB) billing, transfer data, and roll over unused data, other providers may not be.<\/p>\n<p>Examples of cellular providers that are resellers or MVNOs are Afrihost, FNB Connect, me&amp;you Mobile, Mr P Mobile, and Standard Bank.<\/p>\n<h3 class=\"my-4\">Big potential for confusion<\/h3>\n<p>Concerns have been raised in the industry that ICASA\u2019s exemption of MVNOs and resellers does not have the best interests of consumers at heart.<\/p>\n<p>It will also be confusing to consumers who may expect the regulations to apply to their cellular service provider.<\/p>\n<p>MTN, which provides reseller services to Afrihost, told MyBroadband that it agrees there could be confusion down the line based on how ICASA has written the regulations.<\/p>\n<p>\u201cThe regulations apply to all licensed operators. In respect of consumer services, this could create confusion with respect to licence-exempt resellers and MVNOs,\u201d MTN said.<\/p>\n<p>However, MTN clarified that its own compliance controls may remain intact with its resellers.<\/p>\n<p>\u201cA reseller is licence exempt and would not have to comply with the End-User and Subscriber Service Charter regulations with respect to the services they provide to their own customers,\u201d stated MTN.<\/p>\n<p>\u201cHowever, if the resellers on-sell MTN\u2019s products in their original form, then all the compliance controls would have been implemented on MTN\u2019s products.\u201d<\/p>\n<h3 class=\"my-4\">Cell C &#8211; No comment<\/h3>\n<p><a href=\"https:\/\/mybroadband.co.za\/news\/cellular\/286326-all-the-mvnos-on-cell-cs-network.html\"><strong>Cell C offers MVNO services<\/strong><\/a> to a wide range of partners, including FNB Connect, Standard Bank Mobile, Virgin Mobile, MRP Mobile, me&amp;you Mobile, and Trace Mobile.<\/p>\n<p>Cell C did not respond to requests for comment about ICASA&#8217;s regulations.<\/p>\n<h3 class=\"my-4\">ICASA &#8211; No comment<\/h3>\n<p>ICASA did not respond to requests for comment on what its intention was in exempting resellers, MVNOs, and machine-to-machine applications.<\/p>\n<h3 class=\"my-4\">FNB &#8211; Fully compliant<\/h3>\n<p>FNB told MyBroadband that it will comply with ICASA\u2019s regulations, even though it is an MVNO and is not strictly required to.<\/p>\n<p>\u201cIn the interest of customers, FNB Connect has proactively complied with the regulations,\u201d FNB said.<\/p>\n<p>\u201cWe believe that this will go a long way in enabling FNB customers who are on FNB Connect to stretch their budgets by monitoring how much they spend on data.
