{"id":37056,"date":"2011-10-27T21:23:58","date_gmt":"2011-10-27T19:23:58","guid":{"rendered":"http:\/\/mybroadband.co.za\/news\/?p=37056"},"modified":"2011-10-28T11:40:26","modified_gmt":"2011-10-28T09:40:26","slug":"blackberry-outage-lawsuits","status":"publish","type":"post","link":"https:\/\/mybroadband.co.za\/news\/cellular\/37056-blackberry-outage-lawsuits.html","title":{"rendered":"BlackBerry outage lawsuits"},"content":{"rendered":"<p><a title=\"Research in Motion (RIM)\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/313525-Research-in-Motion-%28RIM%29\">Research In Motion<\/a> is being sued in the United States and on its home turf in Canada for a <a title=\"BlackBerry\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/342709-BlackBerry\">BlackBerry<\/a> service outage that affected millions of people worldwide.<\/p>\n<p>The lawsuits seek class action status to represent all BlackBerry users in the respective countries and call for RIM to pay unspecified cash damages.<\/p>\n<p>RIM&#8217;s network services for the popular smartphone were down intermittently for up to three days early this month in western Asia, the Middle East, Africa, Europe, and North and South America.<\/p>\n<p>RIM blamed the failure of a &#8220;core switch&#8221; at a facility in Europe as well as a backup mechanism for the initial problem, knocking out emails and messaging for users.<\/p>\n<p>The problems cascaded as emails backed up at the company&#8217;s server hubs.<\/p>\n<p>RIM has set out to make amends with customers by offering $100 worth of premium applications such as games and hands-free operating programs, but the lawsuits contend the firm should be made to pay instead.<\/p>\n<p>&#8220;The petitioner expected to be compensated for the loss of services to which he was paying a monthly fee for,&#8221; said filings to a Quebec court by the Consumer Law Group firm on behalf of a Canadian man.<\/p>\n<p>&#8220;Instead, he was disappointed to learn that RIM was only offering some free App downloads that he does not want or need,&#8221; the filing continued.<\/p>\n<p>The court document went on to calculate the man&#8217;s financial loss as CAN$1.25 based on his monthly BlackBerry service data plan fee of $25.<\/p>\n<p>A suit filed in US federal court in Southern California on Wednesday accused RIM of negligence, unjust enrichment and breach of contract.<\/p>\n<p>The lawsuits come as RIM defends against fierce competition from iPhones and <a title=\"Android Mobile Oerating System\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/221979-Google-Android\">Android<\/a>-powered smartphones in the coveted mobile market.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Research In Motion is being sued in the United States and on its home turf in Canada<\/p>\n","protected":false},"author":35,"featured_media":30320,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_sma_x_autopost_status":"idle","_sma_x_autopost_error":"","_sma_x_post_id":"","_sma_facebook_post_id":"","_sma_instagram_post_id":"","_sma_threads_post_id":"","_sma_x_attempts":0,"footnotes":""},"categories":[14],"tags":[36,97,937,99],"class_list":["post-37056","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-cellular","tag-active","tag-blackberry","tag-research-in-motion","tag-rim"],"_links":{"self":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts\/37056"}],"collection":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/users\/35"}],"replies":[{"embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/comments?post=37056"}],"version-history":[{"count":1,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts\/37056\/revisions"}],"predecessor-version":[{"id":37058,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts\/37056\/revisions\/37058"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/media\/30320"}],"wp:attachment":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/media?parent=37056"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/categories?post=37056"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/tags?post=37056"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
