{"id":38717,"date":"2011-11-25T09:59:40","date_gmt":"2011-11-25T07:59:40","guid":{"rendered":"http:\/\/mybroadband.co.za\/news\/?p=38717"},"modified":"2011-11-25T10:04:55","modified_gmt":"2011-11-25T08:04:55","slug":"8ta-blackberry-pricing-questioned","status":"publish","type":"post","link":"https:\/\/mybroadband.co.za\/news\/cellular\/38717-8ta-blackberry-pricing-questioned.html","title":{"rendered":"8ta BlackBerry pricing questioned"},"content":{"rendered":"<p>The <a title=\"Advertising Standards Authority of South Africa (ASA)\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/306365-ASA-Advertising-Standards-Authority\">Advertising Standards Authority of South Africa (ASA)<\/a> ruled that an <a title=\"8ta\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/276092-8ta\">8.ta<\/a> <a title=\"BlackBerry\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/342709-BlackBerry\">BlackBerry<\/a> advertisement promoting the service at R90 per month for the first three months is misleading as it does not clearly stipulate all the charges.<\/p>\n<p>This ruling follows a complaint by one consumer who argued that she was billed R522.40 for three 8ta BlackBerry contracts instead of the expected R270 (R90 x 3).<\/p>\n<p>The consumer said that the additional and unexpected charges were because of <a title=\"SMS - Short Message Service\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/289539-SMS-Short-Message-Service\">SMS<\/a> charges, and that this was not clearly stated in the advertisement.<\/p>\n<p>8ta denied misleading the consumer saying that she was billed R90.00 per month per phone as advertised.<\/p>\n<p>\u201cThe complainant was also credited with the cost of SMSs sent, over and above 5 SMSs sent by her on a day,\u201d 8ta said.<\/p>\n<p>The ASA said that the complainant was incorrect to argue that she was supposed to be billed R270.00 a month for three phones as she did not calculate the voice and SMS usage on the phones.<\/p>\n<p>\u201cIt should also be pointed out that the complainant was billed from the time the phones were activated and was charged on pro-rata basis for the duration of the August month. The complainant\u2019s invoice date was 2 September 2011 and the due date was 30 September 2011. It is clear that the bill included the month of September 2011,\u201d the ASA highlighted.<\/p>\n<div id=\"attachment_38721\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/mybroadband.co.za\/news\/cellular\/38717-8ta-blackberry-pricing-questioned.html\/attachment\/8ta-blackberry-2\" rel=\"attachment wp-att-38721\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-38721\" class=\"size-full wp-image-38721\" title=\"8ta BlackBerry deal\" src=\"http:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2011\/11\/8ta-BlackBerry.jpg\" alt=\"8ta BlackBerry deal\" width=\"600\" height=\"236\" srcset=\"https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2011\/11\/8ta-BlackBerry.jpg 600w, https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2011\/11\/8ta-BlackBerry-100x39.jpg 100w, https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2011\/11\/8ta-BlackBerry-185x72.jpg 185w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-38721\" class=\"wp-caption-text\">8ta BlackBerry deal<\/p><\/div>\n<p>So far 8ta is in the clear, but there was one mistake which cost them this case. The advertisement does not indicate or show whether or not <a title=\"CLI - Caller Line Identity\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/384047-CLI-Caller-Line-Identity\">Caller Line Identity (CLI)<\/a> is mandatory or optional. \u201cIn fact nothing is mentioned regarding the cost of CLI,\u201d the ASA said.<\/p>\n<p>\u201cIt is the Directorate\u2019s view that it should have been stated in the advertisement that CLI is mandatory and the cost will be billed as recurring monthly fees.
