{"id":585665,"date":"2025-03-06T10:29:46","date_gmt":"2025-03-06T08:29:46","guid":{"rendered":"https:\/\/mybroadband.co.za\/news\/?p=585665"},"modified":"2025-03-06T10:50:25","modified_gmt":"2025-03-06T08:50:25","slug":"luno-calls-for-new-crypto-regulations","status":"publish","type":"post","link":"https:\/\/mybroadband.co.za\/news\/cryptocurrency\/585665-luno-calls-for-new-crypto-regulations.html","title":{"rendered":"One basic crypto change could unlock huge growth in South Africa, says Luno"},"content":{"rendered":"\n<p>South Africa&#8217;s largest cryptocurrency exchange by users, Luno, is calling on the National Treasury to classify digital assets held on local licensed platforms as onshore assets.<\/p>\n\n\n\n<p>Luno said this would allow the returns from these assets to be reinvested in the country, increasing tax revenue.<\/p>\n\n\n\n<p>&#8220;Currently, digital currencies are not designated as either offshore or onshore assets, making it very difficult for institutional investors to allocate capital or invest in assets such as Bitcoin,&#8221; Luno&#8217;s general manager for Africa, Marius Reitz, said.<\/p>\n\n\n\n<p>&#8220;It also complicates efforts to report cross-border transactions to the Reserve Bank.&#8221;<\/p>\n\n\n\n<p>Reitz said this uncertainty surrounding how digital assets are classified hinders sector growth.<\/p>\n\n\n\n<p>He argued that labelling cryptocurrencies as offshore assets would limit the amount of digital assets fund managers and mutual investment funds can hold.<\/p>\n\n\n\n<p>Reitz warned this would ultimately restrict South Africans and corporate investors from benefitting from potential returns.<\/p>\n\n\n\n<p>&#8220;Internationally, cryptocurrencies are now just another recognised asset class to invest in along with stocks, government bonds and fiat currencies,&#8221; Luno&#8217;s global head of legal and corporate strategy, Paul Harker, said.<\/p>\n\n\n\n<p>&#8220;In the current constrained fiscal reality, our government has little room to manoeuvre. Pro-growth and forward-looking decisions are essential.&#8221;<\/p>\n\n\n\n<p>Reitz said they acknowledge the progress made in regulating cryptocurrency in the country, such as taxing trading profits and licensing exchanges, and work by the Intergovernmental Fintech Working Group<\/p>\n\n\n\n<p>However, Luno believes that South Africans and the fiscus have yet to experience the actual benefits of digital assets.<\/p>\n\n\n\n<p>&#8220;Treasury can take decisions that stimulate growth in digital assets while also ensuring a safe and secure sector,&#8221; Luno&#8217;s country manager, Christo de Witt, said.<\/p>\n\n\n\n<p>&#8220;It is a massive misconception that, in the cryptocurrency sector, huge growth and real safety are mutually exclusive. Further close cooperation between government and industry can remove obstacles.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Exchange control mess<\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"800\" height=\"533\" src=\"https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2021\/09\/South-African-Reserve-Bank-building-address.jpg\" alt=\"\" class=\"wp-image-412316\" srcset=\"https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2021\/09\/South-African-Reserve-Bank-building-address.jpg 800w, https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2021\/09\/South-African-Reserve-Bank-building-address-600x400.jpg 600w, https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2021\/09\/South-African-Reserve-Bank-building-address-640x426.jpg 640w, https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2021\/09\/South-African-Reserve-Bank-building-address-768x512.jpg 768w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/figure>\n\n\n\n<p>Luno&#8217;s call for crypto assets to be classified as onshore comes after the Financial Surveillance department of the South African Reserve Bank <a href=\"https:\/\/mybroadband.co.za\/news\/cryptocurrency\/404599-moving-bitcoin-overseas-from-your-wallet-in-south-africa-a-crime-reserve-bank.html\">told MyBroadband in 2021<\/a> that transferring cryptocurrency from local wallets to offshore exchanges was a crime.<\/p>\n\n\n\n<p>It also said that decentralised finance (DeFi) protocols \u2014\u00a0smart contracts executed by blockchains \u2014\u00a0are considered offshore for regulatory purposes.<\/p>\n\n\n\n<p>This is despite no mechanism existing to legally transfer locally-held crypto assets to offshore exchanges or interact with smart contracts.<\/p>\n\n\n\n<p>Luno&#8217;s plea to Treasury suggests that the onshore\/offshore status of crypto assets held by locally licensed crypto asset service providers is not as clear-cut as the Reserve Bank suggested.<\/p>\n\n\n\n<p>The Reserve Bank&#8217;s feedback to MyBroadband was in response to questions about an FAQ document published on its website by the Intergovernmental Fintech Working Group (IFWG).<\/p>\n\n\n\n<p>The IFWG is a group of regulators comprised of the Competition Commission, Financial Intelligence Centre, FSCA, National Credit Regulator, National Treasury, the South African Revenue Service, and the South African Reserve Bank.<\/p>\n\n\n\n<p>The group of regulators issued an FAQ document in 2021 as part of its position paper on crypto assets.<\/p>\n\n\n\n<p>&#8220;Exchange Control Regulation 10(1)(c) prohibits transactions where capital or the right to capital is, without permission from National Treasury, directly or indirectly exported from South Africa,&#8221; the FAQ from the IFWG states.<\/p>\n\n\n\n<p>It added that this includes transactions where an individual purchases crypto assets in South Africa and uses them to externalise &#8220;any right to capital&#8221;.<\/p>\n\n\n\n<p>Contravening South Africa\u2019s exchange control regulations carries a penalty of a R250,000 fine and possibly up to five years imprisonment.<\/p>\n\n\n\n<p>The fine may be increased up to the value of the offending transaction under certain circumstances.<\/p>\n\n\n\n<p>However, the regulations specifically link this escalation to &#8220;any security, foreign currency, gold, bank note, cheque, postal order, bill, note, debt, payment or goods&#8221;.<\/p>\n\n\n\n<p>The Reserve Bank also banned banks from allowing clients to buy crypto assets from overseas providers using debit or credit cards.<\/p>\n\n\n\n<p>Therefore, the only way to legally buy crypto overseas for use in DeFi is through regular electronic funds transfers.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The cryptocurrency exchange has called on the National Treasury to enact new regulations surround digital assets.<\/p>\n","protected":false},"author":341175,"featured_media":585687,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[44696],"tags":[81105,92151,48303,42992,51443,12285,99049],"class_list":["post-585665","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-cryptocurrency","tag-christo-de-wit","tag-crypto-asset-service-provider-casp","tag-cryptocurrency-exchanges","tag-luno","tag-marius-reitz","tag-national-treasury","tag-paul-harker"],"_links":{"self":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts\/585665"}],"collection":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/users\/341175"}],"replies":[{"embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/comments?post=585665"}],"version-history":[{"count":4,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts\/585665\/revisions"}],"predecessor-version":[{"id":585701,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/posts\/585665\/revisions\/585701"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/media\/585687"}],"wp:attachment":[{"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/media?parent=585665"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/categories?post=585665"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/mybroadband.co.za\/news\/wp-json\/wp\/v2\/tags?post=585665"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
