{"id":631395,"date":"2026-03-01T10:04:59","date_gmt":"2026-03-01T08:04:59","guid":{"rendered":"https:\/\/mybroadband.co.za\/news\/?p=631395"},"modified":"2026-03-02T09:40:39","modified_gmt":"2026-03-02T07:40:39","slug":"man-blames-investec-after-bug-fails-to-stop-wifes-r2-4-million-online-gambling-spree","status":"publish","type":"post","link":"https:\/\/mybroadband.co.za\/news\/security\/631395-man-blames-investec-after-bug-fails-to-stop-wifes-r2-4-million-online-gambling-spree.html","title":{"rendered":"Man blames Investec after bug fails to stop wife&#8217;s R2.4 million online gambling spree"},"content":{"rendered":"\n<p>The Western Cape High Court has ruled in favour of Investec in an application to sequestrate one of its customers after a bug in its card system allowed him to accumulate a credit card bill of R2.6 million.<\/p>\n\n\n\n<p>On 5 February 2025, Investec deployed a change to its internal Credit Card 400 System, which disabled the balance-check function for tokenised transactions.<\/p>\n\n\n\n<p>Modern payment systems often use secure tokens rather than directly using the card details to authorise transactions, which helps combat fraud.<\/p>\n\n\n\n<p>As a result of the technical issue, Investec erroneously processed all its customers\u2019 tokenised transactions, regardless of whether the client had a sufficient balance or an account limit.<\/p>\n\n\n\n<p>Investec\u2019s failure to enforce the customer\u2019s credit limit did not negatively affect its case, with the judge finding that the customer, Izak van Zyl, had not been forthright in his pleadings to the court.<\/p>\n\n\n\n<p>In essence, Van Zyl, a financial adviser by profession, argued that he should not be held liable for transactions made on his credit card in February 2025 that exceeded his R150,000 limit.<\/p>\n\n\n\n<p>Van Zyl argued that it amounted to reckless lending on Investec\u2019s part by allowing his card\u2019s limit to be exceeded to that extent.<\/p>\n\n\n\n<p>He told the court that his wife had used the card to gamble away R2.4 million on Hollywoodbets after she realised the credit limit was not being enforced. Van Zyl said she did this without his knowledge.<\/p>\n\n\n\n<p>However, the judge was unconvinced by Van Zyl\u2019s argument for several reasons. Chiefly, when Investec first contacted him about the debt, Van Zyl tried to arrange a payment plan.<\/p>\n\n\n\n<p>Additionally, the transactions didn\u2019t occur on just one night; they happened over the span of a week, from Wednesday, 5 February to Tuesday, 11 February 2025.<\/p>\n\n\n\n<p>Investec also sent an SMS notification for each transaction as it was processed. According to the judgment, these factors contradicted Van Zyl\u2019s claims that he was oblivious.<\/p>\n\n\n\n<p>Further complicating matters was that Van Zyl had recently applied to increase his credit limit, which Investec had rejected.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Investec Private Bank Account terms &amp; conditions<\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"675\" src=\"https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2026\/02\/Investec-Private-card.jpg\" alt=\"\" class=\"wp-image-631397\" srcset=\"https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2026\/02\/Investec-Private-card.jpg 1200w, https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2026\/02\/Investec-Private-card-600x338.jpg 600w, https:\/\/mybroadband.co.za\/news\/wp-content\/uploads\/2026\/02\/Investec-Private-card-768x432.jpg 768w\" sizes=\"(max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<p>Another element counting in Investec\u2019s favour was that the terms and conditions for its private bank accounts specifically disclaimed the bank&#8217;s liability in situations like this.<\/p>\n\n\n\n<p>\u201cCertain purchases may be processed without pre-authorisation from Investec,\u201d the bank\u2019s terms and conditions stated.<\/p>\n\n\n\n<p>\u201cThe client understands that the credit limit \/ guaranteed account limit \/spending limit may be exceeded as a result of such transaction and agrees to be liable.\u201d<\/p>\n\n\n\n<p>Investec further tells customers that any transaction which results in the credit limit being exceeded shall not render it liable for any such excess.<\/p>\n\n\n\n<p>\u201cIt shall not be construed as the exercise by Investec of its discretion to extend and\/or increase limit, guaranteed account credit limit and\/or spending limit and\/or as a waiver of any Investec rights.\u201d<\/p>\n\n\n\n<p>In granting the provisional sequestration, the judge noted that such proceedings are not civil proceedings for the enforcement of a debt.<\/p>\n\n\n\n<p>\u201cSuch an application may not be used to enforce payment where the debt is disputed <em>bona fide<\/em> and on reasonable grounds,\u201d the judgment stated.<\/p>\n\n\n\n<p>\u201cIn the matter before me, although the debt is founded on a credit agreement, Investec does not seek payment of outstanding monies but a sequestration order.\u201d<\/p>\n\n\n\n<p>The ruling clearly delineates between credit-related disputes and insolvency proceedings. Therefore, the judge believed the provisions of the National Credit Act do not apply in this case.<\/p>\n\n\n\n<p>Although Investec\u2019s technical failure ultimately had little effect on the ruling, they remain noteworthy outside the context of this case.<\/p>\n\n\n\n<p>MyBroadband contacted Investec for comment regarding the provisions in its terms and conditions and asked which types of purchases might bypass an account&#8217;s credit limit under normal circumstances.<\/p>\n\n\n\n<p>We also asked what had caused the bug that allowed tokenised transactions to bypass credit limits, and whether it was a security concern.<\/p>\n\n\n\n<p>Investec did not answer these questions. \u201cDue to a technical issue on our Investec card system, a small number of clients experienced an overdrawn limit issue,\u201d it said.<\/p>\n\n\n\n<p>\u201cThe technical issue has been corrected.
