list for SA rendered useless?"},"content":{"rendered":"<p>The national register to opt out of direct marketing in South Africa will be made obsolete before it has even been implemented, <a title=\"Lance Michalson\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/251836-Lance-Michalson\">Lance Michalson<\/a> from <a title=\"Michalsons Attorneys\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/517557-Michalsons-Attorneys\">Michalsons Attorneys<\/a> recently explained in an article on the firm\u2019s <a href=\"http:\/\/www.michalsons.co.za\" target=\"_blank\">website<\/a>.<\/p>\n<p>This is because the Protection of Personal Information Bill (POPI) will switch South Africa from an \u201copt-out\u201d approach to spam, to \u201copt-in\u201d, Michalson said.<\/p>\n<p>He went on to explain that under the Consumer Protection Act 68 of 2008 (CPA), consumers are allowed to pre-emptively block any direct marketing by registering with a national opt-out list.<\/p>\n<p>Such a national register was never implemented, Michalson said.<\/p>\n<div id=\"attachment_81773\" style=\"width: 610px\" 250w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><p id=\"caption-attachment-81773\" class=\"wp-caption-text\">Lance Michalson<\/p><\/div>\n<p>This is despite the fact that there were at least two opt-out registries for the National Consumer Commission to choose between; one by TrustFabric, the other by the <a title=\"Direct Marketing Association of South Africa\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/420604-DMASA-Direct-Marketing-Association-of-South-Africa\">Direct Marketing Association of South Africa<\/a>.<\/p>\n<p>Under POPI this will all be rendered moot, as the Bill adopts a \u201csoft opt-in\u201d approach to spam.<\/p>\n<p><a title=\"Tobias Schonwetter\" href=\"http:\/\/mybroadband.co.za\/vb\/showthread.php\/237639-Tobias-Sch\u00f6nwetter\">Tobias Schonwetter<\/a>, director of UCT\u2019s intellectual property unit in the Faculty of Law, previously told MyBroadband that POPI requires you to explicitly opt in to direct marketing, with the following exception:<\/p>\n<ul>\n<li>The direct marketer obtained the client\u2019s contact details in the context of a previous sale,<\/li>\n<li>the purpose of the direct marketing pertains to a similar product or service, and<\/li>\n<li>the client has been given the opportunity to opt-out of such communication and has not made use of it.<\/li>\n<\/ul>\n<p>According to Michalson, the new provisions governing spam in POPI will effectively render the national opt-out register moot when the bill comes in effect.<\/p>\n<p>\u201cYou cannot pre-emptively opt-out of something if you first need to opt in,\u201d Michalson argued.<\/p>\n<div id=\"attachment_50527\" style=\"width: 610px\"
