{"id":98258,"date":"2014-03-07T13:37:33","date_gmt":"2014-03-07T11:37:33","guid":{"rendered":"http:\/\/mybroadband.co.za\/news\/?p=98258"},"modified":"2014-03-07T13:38:46","modified_gmt":"2014-03-07T11:38:46","slug":"cell-c-ad-exploits-consumer-ignorance-asa","status":"publish","type":"post","link":"https:\/\/mybroadband.co.za\/news\/cellular\/98258-cell-c-ad-exploits-consumer-ignorance-asa.html","title":{"rendered":"Cell C ad exploits consumer ignorance: ASA"},"content":{"rendered":"<p>MTN has lodged a successful competitor complaint with the Advertising Standards Authority of South Africa (ASA) against a Cell C radio advertisement which takes aim at MTN (<a title=\"Cell C anti-MTN ads\" href=\"http:\/\/mybroadband.co.za\/news\/cellular\/97145-are-vodacom-and-mtn-too-greedy.html\"><strong>Cell C ad available here<\/strong><\/a>).<\/p>\n<p>The Cell C radio advertisement insinuates that MTN\u2019s decision to institute legal action against the new \u201ccall termination regulations, 2014\u201d is aimed at keeping mobile rates high.<\/p>\n<p>The advertisement further advises consumers to move from MTN to Cell C, partly because the money paid to MTN is funding its legal action against the regulations.<\/p>\n<h3 class=\"my-4\">MTN complaint against Cell C ad<\/h3>\n<p>MTN lodged a complaint with the ASA, arguing that its decision to institute the court challenge is its view that the process undertaken by ICASA in finalising the 2014 regulations does not pass muster in terms of administrative law.<\/p>\n<p>MTN further said that there is no link between termination rates and consumer pricing, as indicated in the Cell C advertisement.<\/p>\n<p><iframe loading=\"lazy\" src=\"\/\/www.youtube.com\/embed\/rs4vfxh2pnU\" height=\"315\" width=\"560\" allowfullscreen=\"\" frameborder=\"0\"><\/iframe><\/p>\n<h3 class=\"my-4\">Cell C responds<\/h3>\n<p>Cell C responded to MTN\u2019s complaint, saying that the express intention of Icasa is to lower the interconnect rates to reduce the costs to communicate in South Africa.<\/p>\n<p>\u201cIcasa links interconnect rates to retail rates and to this end, it refers to the concept of \u201cpass-through\u201d,\u201d Cell C said.<\/p>\n<p>Cell C added that it is a fact that MTN are paying high legal fees for the litigation. \u201cIn the case of MTN, the company coffers are funded by cell phone and data usage charges paid by their customers,\u201d Cell C said.<\/p>\n<p>\u201cWe have a duty to ensure that consumers are being told the truth by the industry,\u201d said Cell C.
