    DR Khan the Western Cape Forensic Pathologist has experience in about 100 plus hanging suicides
    And his testimony yesterday presents a pretty compelling open and shut case for a staged hanging/ homicide

    The private pathologist comes across as a bumbling nitwit who was the same one in Oscars trial and doesn't inspire
    Confidence at all.
    I seriously doubt Rohde is going to walk away a free man

    Could since second autopsy is inconsistent with the first there's already a case for reasonable doubt.
    Can this lead to an acquittal for Rohde?

    I don't think so, as the second autopsy was paid for by Rhode.

    Default Jason Rohde 'staged wife's suicide wrong' - pathologist

    Cape Town - Suspicious findings from a Spier Hotel room and Susan Rohde's body suggested a more sinister and calculated death than the suicide that her husband claimed he found, the Western Cape High Court heard on Thursday.

    This version of events emerged as forensic pathologist Dr Akmal Khan, the State's second witness, testified in the murder trial of Jason Rohde.

    He has pleaded not guilty to murder and defeating/obstructing the ends of justice by "staging" a suicide and providing police with false information.

    Khan had dealt with close to 100 suicide hanging cases.

    He visited the scene on July 24, 2016 and wrote an incident scene report.

    He recommended police investigate a possible homicide after noting "odd" blood stains in the room, scratches on her face, and blunt force trauma injuries which suggested a physical altercation.

    Gruesome pictures


    A photo of the hotel room showed it was in a messy state. A purple luggage bag lay open on the floor, the bed was unmade and there were red blotches in different areas.

    "Usually if you have blunt force trauma in the form of a fist or punch, then sometimes you would get an abrasion from a ring on the finger," he explained.

    He thought of Battered Woman Syndrome, where beatings were continuous and over prolonged periods, after seeing the injuries of different ages.

    The stains indicated her body may have been moved.

    Khan wrote another report when he conducted a post-mortem exam two days later.

    Gruesome pictures of Susan's body were projected on the wall.

    Rohde, sitting in seat opposite the dock, turned sideways and seemed uncomfortable.

    Khan detailed the various haemorrhages and injuries on Susan's neck and concluded: "It is a staging of a hanging."

    Judge Gayaat Salie-Hlophe asked what he meant by staged.

    Manual strangulation

    In reply, he said this was putting a ligature on afterward and pressing into the skin to make it look like a hanging.

    "Because you don't how it is supposed to look, you get it wrong."

    He explained that friction abrasions were usually seen with an electric cord used for hanging.

    The ligature mark she had on her neck, which did not slope upward to the point of suspension as with hanging cases, seemed to have been applied after death.

    In most hangings, one would also expect a mark much higher up.

    Khan conducted a bloodless neck dissection to check the marks in detail and confirm they were caused before or after death.

    He found many haemorrhages were unrelated to the ligature. The left horn of the thyroid cartilage had been fractured.

    This indicated "a hand being applied to the neck with a squeezing type of action", consistent with manual strangulation.

    Khan found it was possible to open the locked bathroom door from the outside.

    He felt it prudent to have the bathroom hooks tested to see if they could hold Susan's 52kg weight.

    He said the pooling of blood in the body, which started around 30 minutes post-mortem, indicated she was lying on her back and not hanging when she died.

    He estimated the time of death to be 05:40 on July 24, 2016.

    The trial continues.

    Default Conflicting autopsy reports show different causes for Susan Rohde’s death

    Cape Town – The battle between two pathologists in Jason Rohde’s murder trial heated up in the Western Cape High Court on Thursday after their autopsy reports for his wife showed stark differences.

    The State’s forensic pathologist, Dr Asmal Khan, concluded that Susan died as a result of a lack of oxygen after manual strangulation and smothering.

    He testified about her injuries as the State’s second witness on Thursday.

    Graphic photos from the post-mortem exam were used to show these injuries to Judge Gayaat Salie-Hlophe.

    Part of his testimony included that Rohde "staged her suicide" but allegedly got it wrong because he did not know what he was doing.

    Dr Reggie Perumal did a second autopsy at Rohde’s request more than a week after her death.

    His report suggested her injuries were consistent with ligature strangulation.

    The history he provided was that she had hung herself with an electric cord. This was in line with Rohde’s version that he found Susan’s body hanging from the bathroom door of the hotel room at Spier Wine Estate on July 24, 2016.

    Rohde has pleaded not guilty to killing her and defeating/obstructing the ends of justice by staging a suicide and supplying false information to police.

    Perumal furiously took notes in court but had yet to testify.

    Battered Woman Syndrome

    Khan ripped into Perumal’s report as he read it out loud.

    He highlighted and gave examples of why some sections were "deliberately misleading", incomplete, alleged, unattributed, vague or left open to interpretation.

    Khan had recommended police investigate a possible homicide after noting “odd” blood stains in the room, scratches on her face, and blunt force trauma injuries which suggested a physical altercation.

    Her healing bruises, dated to a week before her death, and fresh injuries made him think of continuous and prolonged abuse over time as with Battered Woman Syndrome.

    He found injuries to suggest she was punched in the face, her neck squeezed with a hand, a hand or object placed over her nose and mouth, her chest or ribs kicked, punched or kneed, and the back of her head pushed against a surface.

    There were signs of a physical altercation before strangulation which lasted more than a few minutes, and could have lasted up to an hour, he said.

    Blood was found in her stomach and small intestine.

    No mention of defensive injuries

    Khan thought she might have coughed up blood and then swallowed it.

    Abrasions on the top of her feet and body indicated she had been dragged, he said.

    He recalled the hotel’s bedroom floor was quite rough.

    Turning to Perumal’s report, he said his chief findings left out very important information.

    He did not mention Susan’s defensive injuries, the fracture to her thyroid cartilage, nor the blood found in the stomach and intestines, said Khan.

    "What type of autopsy did he perform if he didn't check [for blood]?" he asked.

    Perumal’s report listed abrasions but did not state whether they were caused by a ligature, fingernails or manual strangulation.

    Khan said he also failed to give a cause for the fracture of three ribs on the right and associated haemorrhages caused before death.

    His testimony would continue when the trial resumed on Monday.

    The defence indicated it would need quite a few days to take instructions from Rohde and consult with experts before it could cross-examine Khan.

    Sorry I thought Khan's autopsy was performed second not first.

    Yes, those broken ribs could prove to be the death knel for Rhode.

    He's looking at a very lengthy sentence.

    Default Rohde murder trial: State questions impartiality of defence pathologist's report

    Cape Town – A post-mortem report, completed at the request of murder accused Jason Rohde a week after his wife's death, omitted key evidence which could cast doubt over its "impartiality", the Western Cape High Court heard on Wednesday.

    Rohde is accused of murdering his wife, Susan, at the Spier Wine Estate last year.

    State pathologist Dr Akmal Coetzee-Khan determined that Susan had died from a lack of oxygen, following manual strangulation and smothering.

    Rohde requested an independent post-mortem from Dr Reggie Perumal.

    However, in court on Monday, Coetzee-Khan testified about several concerns he had with Perumal's report.

    These included that:

    - Perumal overlooked injuries to Susan's neck which, in his view, are important to determine that she was strangled by hand;

    - Perumal did not request photographs of Susan’s body before completing the post-mortem and making dissections;

    - Perumal overlooked injuries on Susan's left hand, as well as blood present in her stomach and intestines.

    Coetzee-Khan pointed out that it was nearly impossible to restore neck tissue to its original form after a post-mortem.

    "How could Perumal complete a post-mortem on the neck if he doesn't know in what condition the tissue was in before dissection," he asked.

    Possible confrontation

    He said he was "really concerned about the findings of Perumal's report" and the impartiality of the findings made.

    Judge Gayaat Salie-Hlophe asked Coetzee-Khan whether Rohde's version of events, that a confrontation occurred before Susan's death, corresponded with her injuries.

    However, he responded that he was not provided with the specifics of the confrontation to "map out" which injuries occurred from the altercation.

    He said Susan's injuries to her knuckles and scarring to her legs could have been caused in a confrontation.
    However, the injuries to her neck were still not explained, he added.

    Coetzee-Khan told the court that the bruising to Susan's eye was consistent with direct contact, which could have been caused by Rohde hitting her with the back of his arm.
    Coetzee-Khan has not yet been cross-examined.Judge Salie-Hlophe postponed the matter to Wednesday afternoon at the request of Rohde's counsel, Pete Mihalik.

    Dressed in a dark blue suit, Rohde appeared relaxed throughout the court proceedings.

    If rationality came into play in this kind of decisions, they wouldn't do a botched murder disguised as a robbery or a suicide !
