Default Senior managers 'running the ship' in wake of CEO's arrest for murder

Cape Town – Sotheby's International Realty South Africa on Tuesday noted the arrest of one of its top executives, but said it could not comment further at this time.

Jason Rohde, 47, CEO of Geffen International Realty Franchises, was arrested in Johannesburg on Tuesday morning in connection with his wife Susan's murder.

"While Jason is on leave a team of senior managers from head office is running the ship and everything within the company is operating as normal," Sotheby’s spokesperson Samantha Bartlett told News24.

"Any further questions should be directed to the South African police or the department of public prosecutions," she said.

Susan Rohde, 47, was found dead in a bathroom of Spier Wine Estate in Stellenbosch on July 24. Sotheby’s had hosted its annual conference at the venue for the weekend.

Western Cape police confirmed to News24 that a 47-year-old man had been arrested in Johannesburg around 06:50 on Tuesday, and the man's lawyer, Daniel Witz, confirmed his arrest to Netwerk24. He was arrested in the presence of his three teenage daughters.

    Argument over 'affair'

Witz told Netwerk24 that Rohde had met with police in Stellenbosch last week and agreed that he would travel to Cape Town at his own expense and hand himself in if they wanted to arrest him. He was told the investigation was continuing.

Rohde was reportedly shocked that police had gone back on their word and had arrested him at home.

He was being held at the Randburg police station pending his first appearance in court.

Following the initial registration of an inquest docket, the results of the State pathologist’s post-mortem led to the cause of her death being changed to murder.

Witz previously said that according to his client, he and his wife had woken up together that Sunday morning.

"She went into the bathroom to get ready and he fell asleep. When he awoke to get ready for a breakfast talk, he was unable to open the door," he said.

Hotel maintenance was called to assist. Once opened, he found his wife hung behind the door, he told News24.

Allegations of the couple being involved in an argument at the hotel's bar on Saturday night, where Susan apparently "stood in public and said she knew he was having an affair" were irrelevant, Witz argued.

Default 'Please make sure my daughters are okay' - property mogul arrested for wife's murder

Johannesburg - There was no warrant presented for the arrest of Geffen International Realty Franchises CEO Jason Rohde on Tuesday morning, his lawyers said.

"No arrest warrant was presented. Rather, they showed the prosecutor in Randburg a letter from the Department of Public Prosecution [in the Western Cape]," Rohde's lawyer Daniel Witz told reporters outside the Randburg Magistrate's Court.

Rohde, 47, was arrested at his Bryanston home around 06:30 on Tuesday in connection with his wife Susan's death.

Susan, 47, was found dead at the Spier Wine Estate on July 24. Sotheby’s had hosted its annual conference at the venue for the weekend.

Rohde was expected to appear in a Johannesburg court following the arrest, however, it was decided that he would be transferred to the Western Cape where he would appear in Stellenbosch later in the week.

"He may appear on Thursday morning at the Stellenbosch Magistrate's Court and we will apply for bail at that stage," Witz said.

A preliminary bail affidavit had already been prepared and handed to the State and Rohde's legal team did not foresee any reasons why bail would be opposed, Witz said.

"Mr Rohde is a resident in South Africa, all his interests are in South Africa and his entire family resides in South Africa," Witz said.

    'Family in shock and traumatised'

According to Witz, Rohde's family, including his three daughters, were traumatised by Jason's arrest.

"The family is obviously in shock and traumatised, but luckily the grandparents are looking after and support the family," Witz said.

Witz said Rohde himself was "keeping strong" and had asked the lawyers to make sure his daughters were okay.

"Throughout this whole ordeal he's said to us, 'please make sure they're okay, please make sure they're okay', and we're keeping his interests at heart," Witz said.

A group of about 10 or 11 police officers arrived at Rohde's home and proceeded to arrest him while his daughters were still in the house.

According to Witz, Rohde did not expect the arrest, as he had offered to turn himself in voluntarily during a meeting with the investigating team in Stellenbosch last week.

"During this whole stage, he has co-operated with the investigation and it came as a big surprise to us.

"Mr Rohde got a ring at his doorbell at 06:30 this morning. Obviously he didn't know what it was about and there were two arresting officers from Stellenbosch with, as we've been told, eight or nine armed policemen to arrest one man."

    Hanged behind bathroom door

Following Susan's death, an inquest docket was opened, however, the results of the State pathologist’s post mortem led to the cause of her death being changed to murder.

Witz had said at the time that, according to his client, he and his wife had woken up together that Sunday morning.

"She went into the bathroom to get ready and he fell asleep. When he awoke to get ready for a breakfast talk, he was unable to open the door,” he said.

Hotel maintenance was called to assist. Once opened, he found his wife hanged behind the door.

Allegations of the couple being involved in an argument at the hotel’s bar on Saturday night, where Susan apparently "stood in public and said she knew he was having an affair" were irrelevant, Witz argued.

The couple have three daughters - an 18-year-old and twins who are 16.

This case reminds me of Fred van der Vyver who got US experts who got him off by saying his fingerprints were lifted and transplanted.

Default Property mogul hires top team to fight murder charge

Cape Town - Property mogul Jason Thomas Rohde has armed himself with a top-class pathology expert and an entire team of lawyers as he prepares to defend himself against allegations that he killed his wife Susan at Spier Wine Estate last month.

The pathologist conducted an independent investigation and concluded Rohde’s wife had committed suicide at Spier and she was not murdered, Rohde’s attorney, Tony Mostert told the Cape Argus on Tuesday.

He took issue with reports that a State post mortem report concluded Rohde’s wife had been strangled with bare hands.

“We have an independent pathologist who says there is no doubt that it was a suicide,” Mostert said.

He explained that, once Rohde and his legal team noticed the police investigation was moving “in a certain manner”, they called for an independent pathologist’s view in order to “safeguard our client’s position”.

Default They’ve destroyed him and his childrens’ lives – Rohde’s lawyer

The State has illegally arrested murder-accused property mogul Jason Rohde, acted in bad faith and destroyed him and his childrens' lives, his lawyer said on Thursday.

Addressing the Stellenbosch Magistrate’s Court, Pete Mihalik read out his client’s affidavit to explain how he had been treated.

He said that after Susan Rohde’s death at Spier Estate in Stellenbosch last month, her husband co-operated with the police at all times and flew from Johannesburg to Cape Town three times.

Despite this availability, seven armed men pitched up at his home early on Tuesday morning and traumatised his three minor daughters by "dragging him out bed" to drive him to Cape Town, Mihalik said.

His teenage daughters would have been left alone had it not been for the presence of his elderly parents, who were visiting.

Rohde, CEO of Geffen International Realty Franchises, said in his affidavit that the detective in charge was evasive and did not have a warrant of arrest.

The detective presented a letter from a deputy director of public prosecutions, saying he should be arrested.

"This was highly unnecessary and not in line with the principles of justice."

Rohde said it was a violation of his constitutional rights and a contravention of the police’s standing orders.

Police were in possession of his passports, his laptop, and passwords for the laptop, and his wife’s phone.

    Arrested without warning

He also willingly submitted himself for a DNA swab and a check for injuries.

"I had no injuries, apart from a small cut on my finger which happened on the Tuesday in front of my children."

Rohde said he was told the investigation was three months from completion.

While there was agreement that he would willingly hand himself over, he was arrested without warning, and illegally, he said.

Wearing a sports jacket and jeans in court in Thursday, he stared straight ahead with little expression on his face.

The State requested a seven-day postponement for his bail application, but this was opposed by the defence.

An indigant Mihalik replied: "Now they stand up and say they need time. Don’t they know why he’s here?"

Susan, 47, was found dead at the Spier Wine Estate on July 24. Sotheby’s had hosted its annual conference at the venue for the weekend.

She was found in the bathroom, reportedly with a cord around her neck.

Police initially opened an inquest docket for an apparent suicide, but changed it to a murder investigation after the post-mortem results.

His children look quite capable of looking after themselves for a few hours.

    More pressing is this IMO:
The detective presented a letter from a deputy director of public prosecutions, saying he should be arrested.
Lawyers for people like this love looking for technicalities. The police service service always seems to oblige them.

    Default Sotheby boss’s wife’s death a suicide - pathologist

Cape Town - A marriage counsellor on two occasions warned that the wife of property mogul Jason Rohde was a suicide risk.

This emerged in the Stellenbosch Magistrate's Court on Thursday when he made his first appearance in connection with her murder.

    ...

However, Rohde has hired a private investigation team which includes an independent pathologist who concluded that her death was consistent with suicide.

The pathologist's report was handed to the court and states that an upper bone in Rohde's wife's throat would have been fractured if she was strangled. This, however, was not the case.
