    No 'insanity' escape for dog sex accused

    Pretoria - Attempts by the family of a Bronkhorstspruit man - accused of sexually assaulting his parents' domestic worker and then forcing her to perform sexual acts on his dogs - to avoid prosecution would not fly.

    Prosecutor Solly Ledallo spoke in court where the National Prosecuting Authority was opposing the application to send him to Weskoppies Psychiatric Hospital for observation. He said the family was only trying to influence the man’s criminal case.

    “We are opposing this application because one of the strategies used by suspects to avoid being prosecuted is faking mental instability. This application could see him sent to the Pretoria hospital for 30 days for observation. We are well aware that suspects often go to Weskoppies and then act as if as if they are not mentally stable to avoid facing the consequences for their actions,” Ledallo argued.

    The 45-year-old accused was arrested in November and his first appearance attracted protest action from angry EFF and ANC members.

    WTF? Are the NPA claiming that the Doctors of these institutions are not qualified to diagnose people with mental illness and can be deceived by "acting"

    And it's not an escape. The guy should just be locked up in a mental institution and not a normal prison if he has a mental illness that makes him dangerous.

    Dog DNA analysis delays case of man accused of raping his domestic worker

    Pretoria - The case against a 41-year-old man, who allegedly raped his domestic worker and forced her to perform sexual acts with his dogs, has been postponed.

    The Bronkhorstspruit Magistrate's Court heard on Tuesday that the State was still awaiting DNA samples from the dogs which may or may not positively provide help prove that the victim was forced to perform sexual acts with the animals.

    The accused's lawyer, Ehleketani Maluleke, told the court that she had been instructed to bring a bail application at the accused's next appearance, following testimony from a psychiatrist that he is fit to stand trial.

    She would also apply to have the accused's dogs released to his parents.

    State prosecutor Solly Leballo told the court that they would oppose the application for the dogs to be released until the samples were ready.

    He added that the DNA samples for the victim and the accused had been completed and received.

    Mentally unstable

    During a previous court appearance, a psychiatrist who evaluated the accused for seven days, declared that he was mentally fit to stand trial.

    On the back of the testimony, the court also dismissed an application by the defence to have the accused admitted to Weskoppies Psychiatric Hospital in Pretoria for mental observation.

    The accused's father previously testified that his son had always been mentally unstable.

    "One moment he would be fine, the next he would be angry, swearing, shouting, fighting and breaking things."

    He said this behaviour had started when his son was 9 years old.

    "In mid-1993, he got so bad… he got angrier and more violent, that we took him to the district surgeon in Potchefstroom to have him observed because of his unacceptable behaviour.

    "They sent him to Sterkfontein Psychiatric Hospital in Krugersdorp. He was there for two weeks, where they diagnosed him as mentally... [challenged]."

    The father also testified that in 1999, his son had set himself alight and had sustained burn wounds over 33% of his body.

    The accused has been charged with 10 counts, including five of rape and three counts of sexual assault, after he allegedly dragged and locked the victim in a room, where he raped her repeatedly.

    The domestic worker was working in the house, where the accused lived with his parents in Raimar Park, Bronkhorstspruit, when she was allegedly accosted in October 2017.

    The case has been postponed to March 19 for a formal bail application.

    BRONKHORSTSPRUIT - The bail hearing of a 45-year-old man, accused of raping his parents’ domestic worker and forcing her to perform sexual acts on his dog, got off to a bad start on Monday in the Bronkhorstspruit Magistrate’s Court, when people in the public gallery furiously told Magistrate David Shikwambana to stop lecturing them.

    Tempers flared up after Shikwambana asked the people in the public gallery to be disciplined and accept every outcome of the bail application. He made the appeal shortly before the start of formal proceedings.

    “An hour ago I greeted you by saying revolutionary greetings,” said Shikwambana to a quiet courtroom.

    “I regard you as my brothers, sisters, uncles and fathers. If the law allows me to refuse bail, I will refuse it. If the law allows me to grant bail, I must grant it and walk freely at that [shopping] mall.”

    Several people interjected and openly shouted at Shikwambana. One of those who shouted was Tshwane whip of the African National Congress (ANC), Jabu Mabona.

    Mabona stood up, walked to the front row of seats and told Shikwambana it was not necessary for him to say that.

    “We have been attending this case for many months. Why are you lecturing us today? We understand your work and stop lecturing us and do justice,” said Mabona.

    Economic Freedom Fighters (EFF) member Alfred Manala said Shikwambana must stop wasting their time.

    Accused's DNA in domestic worker rape case tests positive

    Pretoria - The DNA results of a 41-year-old man, who allegedly raped his domestic worker and forced her to perform sexual acts with his dogs, has tested positive, the Bronkhorstspruit Magistrate’s Court heard on Monday.

    During the bail application of the accused, who cannot be named to protect the identity of the victim, Captain Shane Van Rooyen - who stood in for the investigating officer - told the court that the accused’s DNA had been found in the victim’s vagina.

    He further testified that the victim’s genitals were bruised and that she had an open wound on her right thigh.

    Van Rooyen said they were still awaiting the DNA tests of the dogs, which may or may not positively prove that the victim was forced to perform sexual acts with the animals.

    The court heard that the victim was an employee of the accused’s parents and that, during the course of the day October 23, 2017, the accused had refused to allow the victim to leave the premises and had "kept her in his room where he raped her at different times".

    "The victim says she was raped five times," said Van Rooyen.
    He added that the accused had allowed the dogs into his room,

    where he forced her to perform oral sex on them and allowed the dogs to have intercourse with her.

    Van Rooyen further testified that the accused’s parents came to the house, but left after an argument with the accused, and that the victim only managed to escape in the early hours of morning on October 24.

    "The victim used something to spray the accused person and [she] escaped wearing only a towel."

    He added that she was helped out of the house by the accused’s father, and then she had run to the neighbour’s house where the accused’s mother dropped off her clothes.

    'It was not the first time we had sex'

    Van Rooyen said the neighbour would testify that she saw the accused’s father opening the gate for the victim after coming to investigate screams that she had heard. The neighbour also initially thought the screams were part of a reoccurring spat between the accused and his parents.

    During the bail application the accused's lawyer, Ehleketani Maluleke, read an affidavit by the accused in which he states that he and he domestic worker were in a relationship and that the sex was consensual.

    "It was not the first time we had sex," Maluleke read from the affidavit.

    She also read an affidavit from a witness for the defence, which stated that the victim and accused had been in a relationship and that she would often "chill and drink with them" at a tavern in Bronkhorstspruit.

    However, the State argued that the accused’s statement made no mention that people knew about the relationship.

    In his father’s statement obtained last year, he also did not mention that the accused was in a relationship with the victim, Van Rooyen told the court.

    Maluleke also told the court that the accused had one previous conviction for driving under the influence of alcohol, committed 22 years ago. He added that the accused had previously been married, but that his wife had died in 2005.

    During a previous court appearance, a psychiatrist who evaluated the accused for seven days, declared that he was mentally fit to stand trial.

    History of instability

    On the back of the testimony, the court also dismissed an application by the defence to have the accused admitted to Weskoppies Psychiatric Hospital in Pretoria for mental observation.

    Jubilation as rape accused denied bail

    MASSIVE celebrations broke out after the Bronkhorstspruit magistrate’s court denied bail to the man accused of raping his family’s domestic worker before forcing her to have sex with his dogs.

    EFF and ANC members burst into song when the court made the second judgment against the accused this year. Magistrate France Tsatsi had earlier rejected an application to have the accused sent to Weskoppies Psychiatric Hospital for observation.

    Yesterday prosecutor Solly Leballo said he was proud of the favourable judgment, but said the State was always confident it would convince the court to rule against the bail application as it did the psychiatric observation application.

    The accused was a desperate man who initially wanted go for psychiatric observation and then fake mental illness, he said.

    The suspect, 45, lodged the bail application on Tuesday after abandoning it last year for safety reasons when angry community members led by the ANC Women’s League and EFF demonstrated outside the court.

    Dog DNA analysis completed in domestic worker rape case

    Investigation in the case against a man who allegedly raped his domestic worker and forced her to perform sexual acts with his dogs has been completed after the dogs' DNA results were finalised.

    The Bronkhorstspruit Magistrate's Court also heard on Tuesday that the case would now be transferred to the Pretoria Regional Court.

    In March, the State asked for a postponement as it was still awaiting the results of the dogs' DNA analysis. The results are pivotal to the State's case as it is alleged the accused forced the victim to perform oral sex and have sex with his dogs.

    The accused, 45, cannot be named to protect the identity of the victim.

    Magistrate David Shikwambane dismissed the accused's bail application in March. He said that the accused was unsuccessful in proving that it was in the interest of justice for him to be released on bail.

    Shikwambane added that the peace and security of the public would be undermined if he was released.

    Victim allegedly helped by accused's father

    During the bail application, the court heard that the accused's DNA had been found in the victim's vagina and that the victim's genitals were bruised, and she had an open wound on her right thigh.

    The court heard that the victim was an employee of the accused's parents and that, during the day on October 23, 2017, the accused had refused to allow the victim to leave the premises and had "kept her in his room where he raped her at different times".
