and the actual law that you keep referring to does not say, "appears" it says "depicted" as in a drawing or painting etc. in other words you may not draw or paint nude kids.

Has that part of the law actually been tested in court? Our government makes lots of badly worded laws, this seems like one that would get slapped down in a second because it's all about interpretation.

How did we get from having an image of a minor (or an adult that looks like a minor) to pornos?

Depicted can be a photograph or video as well

(xv) "publication" means-,
(a) any newspaper, book, periodical, pamphlet, poster or other printed matter; (
b) any writing or typescript which has in any manner been duplicated; 10
(c) any drawing, picture, illustration or painting; (
d) any print, photograph, engraving or lithograph;
(e) any record, magnetic tape, soundtrack, except a soundtrack associated with a film, or any other object in or on which sound has been recorded for reproduction; · 15
(f) computer software which is not a film; ·
(g) the cover or packaging of a film; and
(h) any figure, carving, statue or model; (x)
