An Eastern Cape court has ruled that a young victim of medical negligence be provided free medical care at the state's expense rather than a lump sum payout.

The Bisho High Court ruling, which may set a precedent for medical negligence cases, goes against the established practice of paying lump sums "on a once and for all basis" administered by a trust.

 
Hmmmmm... probably not a good development.
Could this be yet another EC fail?

Well, it is a win for government. Both the courts and government knows there will be no treatment as the system has collapsed and also the reason why the client almost died. So, corrupt courts covering a corrupt government in my opinion.
 
Griffiths ordered that all the 11-year-old's future healthcare needs – from physiotherapy and surgeries to meetings with neurologists, be provided by the state for free.

This is the only problem I see, the hospital can now just delay appointments and make things difficult. Should have been all costs will be paid by the state.
 
So now you have to go back to a state hospital, which fscked you up in the first place, and hope that they will 1. treat you and 2. not fsck you up further.
Yeah was thinking this as well. I'm sure most people will take the money and go private. Or pocket it and stay ****ed up :laugh:

Future meds gets eaten up by attorneys and hospitals are difficult. This is a good ruling in my opinion.

No, it is not. This is paving the way for state hospitals to care even less and f**k people up even more, as they know there will be no consequences. This is exactly what the ANC wanted. If you thought service delivery was bad, wait and see what happens now....
 
I see what you mean. I worked for attorneys and future meds are a difficult thing. And hospitals are difficult. I always thought this would be the better solution. But as you pointed out they just send them back to the hospitals that f up.
Should have been at any hospital the state had to pay the bill.
 
Come to think about it, this ruling is the same as when a woman gets raped and the court tells her to go back to the suspect and speak it out with him.
 
NHI ground rules being implemented. This will soon effect private medical members.

Once NHI comes into effect all private medical aid members will also be visiting state hospitals in any event. Everyone will sit in the same rows. Everyone will be seeing the same doctors.

Technically it's the doctor and not the hospital that caused the problem so you can be treated by someone different, not that the state hospitals currently have consistently excellent doctors to choose from.
 
Good ruling. People do this shyte on purpose a lot to get a payday in both private and public sectors.

Unfortunate in this particular case but in the grand scheme of things it's good.

You won't believe what people try to sue for lol
