New land expropriation laws for South Africa are coming

Nedbank came out to clarify this. The original owner will still legally have to pay their bond. EWC does not force majeure the loan.

They are wrong. Many advocates and attorneys do not agree with them. Even my bond agreement with the bank clearly states that my loan included both the land and the infrastructure anywhere on the land. Force Majeure will stand 100% in court if a third-party takes my rights away and the land is no longer mine as per the agreement. In addition to this, my bond agreement do make provision for Expropriation with Compensation, but no mention or provision for EWC. This is legally where the bank will hit a wall in courts when Force Majeure is claimed.

The only way the bank will get away with this, is if they do not include the land itself in the bond agreement and only the infrastructure. By the way, I wonder if they already changed their bond agreements to facilitate this?

As for mine, they will be out of pocket with no legal recourse if the government do EWC.
If they did it in Zim then the ANC will do even better for SA. There are many creative ways to do EWC and keep the loan agreement in place.

There is no way, unfortunately. Any move removing my ownership rights will lead to immediate termination of the agreement on the basis of force majeure, just like Transnet did, and that is that. Everyone loses. The ANC can, however, wait another 20-30 years until I have settled the bond and then EWC the property. But, by then I would have sold it off to another person and that would not be my problem. Any person, black or white, has to be stupid to own a property in SA in the next 20 years when the biggest political parties all support EWC and nationalization of land.

They`ll let you keep ownership but also allow others to live on your property. You have ownership but need to pay a fee to stay there. Previous disadvantaged can also live there but does not have to pay the fee.

Not going to happen. I choose who lives on the property. If this right is taken away from me, it is tantamount to the property rights being taken away as well. Good luck to them fighting this in court.

They just change the law and then the court is useless.
 
LOL, no, your flat is bound to the land! They will take the land and all buildings on it, as well as your IP, which won`t be a loss in this case.
