National assembly passes bill to criminalise hate speech and hate crimes

We do live in troubling times but it’s simple, don‘t be an a55hat and you’ll be fine.
Sadly once again I overestimated the capabilities of the forums 30%ers

So when the cops come knocking at your door because someone who doesn't like you reports you for having said something hateful, I guess we can all just shrug and say you should have kept "your molly coddled angry white bish mouth closed"?

These “someone” people could also maliciously accuse me of any number of other currently illegal activities, it’s not like the legal landscape will have suddenly changed.

But I appreciate where you are coming from, as an angry person that likes shooting your mouth off this new bill would feel rather ominous, I feel your pain.

It serves to embolden fscktards who would take advantage of this in a heartbeat. What's hard to understand here?

Says the guy on an unhinged rant about white people two posts up. Take a gander in the mirror there, stallion.

Karen detected, lighten up sunshine, we live in shthole this new law isn’t going to make it materially any worse other than for the fktards who can’t keep their stupid mouths shut when they lose their sht.

These things happened before the bill, and I asked you how this "bill" is going to be abused and any different to how things are now?
I'm demonstrating a pattern of abuse when it comes to the already non-criminal concept of hate speech.

We've had a whole bunch of racist incidents these past few months(and not light stuff too; attacks, threats, people comparing humans to animals, even actual terrorists).
Not really relevant to the concern I've raised, which is the avenues for abuse.

What in the bill has changed?
You mean since it was first proposed? Not sure. What does and doesn't constitute hate speech is not something that's objectively quantifiable. The wording of the bill won't change that, neither will it address the history of abuse of the term ahte speech we've seen over the last few years.

That impossibility of creating any objective standard is why I'm against hate speech laws in general. Make it a civil matter between individuals sure, but don't get the state involved to criminally charge people.

The problem is that whether or not you did something like kill, rape or steal from someone is something that can, through analysis of evidence etc., be objectively determined.

Whether or not what you said constitutes hate speech is far more mercurial.

Imagine this with “white” replaced with “black”

No one on this forum will defend you.
What I said was a great stereotype, some people on the forum love stereotyping, I thought I would do it just for them :sneaky:

Has anyone ever been convicted of mild hate speech?

Considering how screwed our criminal justice system is, just the fact of being accused of any criminal behaviour is hectic in South Africa. But the real question is why are people paranoid that someone in the future will falsely accuse them of any crime, what are you planning on doing??!

Someone I know moved in to a complex at the beginning of the month. By chance she'd met the previous tenant earlier when viewing the place and she seemed like a decent person. Fast forward to move day and when she entered the place she found it trashed. The previous tenant had destroyed the kitchen, ripped out fixtures...even pissed on floor, ffs. Clearly a dispute with the landlord, probably over a withheld deposit or whatever but if someone is capable of such malice then what's to say she wouldn't accuse the landlord of calling her the dreaded name? Or blackmail to get her deposit back and more?

Just one example.

Indeed. You also observed that forum is swamped with EFF & ANC people and you can't say anything racist towards blacks? Racism towards whites is so tolerated here as there are hardly few of us brought up in western culture.

Do you have plans to start a new forum ?

Sounds like I hit a nerve.

No. But listen too yourself for a bit.

The big instance I have in recent memory was Kenny Kunene being found guilty of hate speech for calling Malema a cockroach and little frog. That's not even mild hate speech, it's not hate speech at all.

I'm not planning on doing anything. My point is that something largely innocuous, like calling someone a cockroach, can happen and be irrationally regarded as hate speech. The subjective nature of hate speech in particular is what makes penalties around it so scary.

You can determine through evidence if someone was raped, and if the individual in question did it. How exactly do you determine whether or not something was hate speech? How someone feels about it? If you can't see how that's concerning I guess we agree to disagree and I hope you never end up in a situation that causes you to realise why this concerns me.
