Another problem for him on appeal is that 5 years is already on the low end of the sentencing range. There's some risk he comes away from the higher court with a longer sentence.
 
He's appealing and that's going to take a while. It'll exhaust the system and eventually it'll be reduced down to a fine.
 
All that matters is that he is free to sing his hit song.
Remember they gave him the chance to appeal with another court, which is lawyers have duly obliged.

Now its down to time, delays, missed court days etc .... The Zuma book.

He can't be a MP ( sort of ) though - until its all over, its down to how deep his wallet and lawyers can take it.
 
Haven't read the judgment. But anyone is allowed to handle and use my firearm under my supervision. Doesn't matter if they have a competency, or are competent or trained to use it.

Sure, I get you, but the court indeed rejected that he had the gun under legal supervision. I'd imagine that is very hard to argue outside of a controlled environment such as a range when the gun is actually loaded.

if Malema get of scot-free it will set a president for the gun laws in SA.

He will go, but it will 'symbolic', and the criminal is going to milk it dry. I still have many questions in regard to Zuma's imprisonment, but hey, who am I to question? It will be the same with Malema, but Malema has a big mouth. I won't be surprised to see him go the "Mandela" PR route.
 
If you read what he is going to prison is not firing the gun. He only got fined for that.

He got given a 5 year prison sentence for unlawful possession of a firearm. He was handed the gun and gave it back.
He also got a concurrent sentence of 2 years for being in possession of ammunition as the gun was loaded.

The appeal will focus on the possession of a gun for 1 minute is unfair. They will look up case law where maybe a gun owner handed a gun to a family member and told them to test shoot and that family member didn't get charged. I would think the person who owned the gun is in fact more liable for handing over a gun temporarily.

This case is easily appealable and as in the Oscar Pistorius case this shows the world what a joke South Africa's legal system is with the initial finding. Lots of fancy words and long verdict which means very little.

In my view he should have gotten a prison sentence for the planned firing a gun in a crowded area which was the most egregious act. But he didn't. He just got fined for that. And that is the flaw.

I believe the appeal's court will find in his favour and he then claim to be a victim of a white judge.
Keep in mind that it's a fully automatic assault rifle which illegal to be in the possession of a civilian. Doesn't matter if he took it and handed it back, it should never have been present in the first place, let alone being used by a civilian...

I think what you should be saying is the sentences you list are out of touch, not Malema's.
 
I think he is going to prison. His political capital is spent. Even Floyd abandoned him.

Well his lawyers have successfully filed / applied for appeal, so no he won't and can't go to jail as it moves over to the higher courts, so I'm guessing he will bounce in between courts over the next few years. However all this is going to cost him plenty, high courts and even the ConCourt are not cheap.

money is no object to those in the political elite, how much did all the back and forth with Zuma lawyers cost, plenty and Zuma still managed to live a life in luxury in Nkandla.

same thing will happen here, Malema will fundraise and steal and enrich himself some other way, just like people who remember him being kicked out of the ANC youth league,
