I find it hard to think that they missed it, since even before he was a DA MP, he had a big public profile online. They probably knew about it but did not think it was disqualifying.

Calling it a forex violation is a stretch tbh. Arbitrage by definition is trading one thing for another. SA might have "lost" R4bn worth of forex, but it gained that much in terms of BTC that now sit in SA exchanges. Which will in effect lower the price of BTC for everyone.

It is no different than if someone sees that Chinese cars are cheaper in China due to SA stealerships, imports them, and sells them for a profit in a nice online store.
