The connection between Biden and Brown’s immigration policies and the car crash was slapped down by FactCheck.org. But most egregious about the ad was the fact that the story and images of the family were used without permission.

The loved ones of a family tragically killed in a car accident are speaking out about the use of their image and story without permission in a Jon Husted campaign ad. Lynnea and Luke Soposki and their one-year-old son Logan were killed in a car crash in April in Ohio. The suspect arrested and charged with vehicular homicide was an immigrant.

The National Republican Senatorial Committee ran a campaign ad for Senate candidate Jon Husted, approved by his campaign, that used the Soposki family tragedy to attack the immigration policies of Democrats, including Joe Biden and former Senator Sherrod Brown. “Sherrod Brown opened our borders to dangerous illegals,” the voiceover in the ad says with images of Brown and Biden. “The consequences were deadly.”

 ”Our grief is not raw material for a campaign, and their images are not public property to repurpose for anyone’s advantage,” family members said in a statement. “Footage of the crash site and a photograph of the three of them are being used, without our consent, in an advertisement from Senator Jon Husted’s campaign…We were not asked and we would not have agreed.”

“We are asking that the advertisement be taken down, and that our family’s images and this tragedy not be used in political messaging by any campaign, going forward. We would ask the same of any candidate, of any party, who did this. We are asking it now of Senator Husted.”

Update: According to the NRSC, the ad has been pulled as of Wednesday
