Now we're entering proper TIA territory. When you have a incompetent municipality, doing it by the book isn't necessarily the right way to go. What stops you YOLOing it like the previous guy and getting on with your life?

For most people, the finance institution who is supplying the capital to purchase the property...
 
I had an inspector visit my property 3 times during the course of the purchase to ensure everything is as it should be, before final paperwork was approved.
 
Hi all, I've put in an OTP for a house, and the OTP expired without a word from the Agent. Am I allowed to put in an OTP with another agent listing the same house? Will they accept it and can there be any repercussions for me?

I would personally follow up with the current agent.

If the owner's was serious, they would have given feedback before expiry.

Be a bit careful here. Estate agents are snakes. There's a whole lot of case law regarding "effective cause" of a sale, where the first agent may potentially have a claim in respect of the commission from the 2nd agent if the first can prove they were the effective cause.

Reach out to the agent first and get some feedback before approaching another one.

Don't do it. If the offer is accepted, the seller is wide open to a double commission claim. The only way to avoid that would be for the second agent to indemnify the seller against any double commission claim.

As the other poster said, "effective cause" is always going to be an issue.

Imho, speak to the agent to confirm that the OTP was actually presented to the seller and that it wasn’t accepted or signed before it expired. It’s just a quick check, especially if you plan on changing any terms in your new offer.

There are no repercussions for you, regardless of how you choose to submit a new offer. Any repercussions would be on the seller, depending on the agreements they’ve signed with the agents - the agent who is left out might claim that they were the one who introduced you to the property through their marketing efforts but that would be a fight for the owner to resolve.

did you actually go and view the property with this agent? if yes then you are most likely stuck with them... if no and you just looked at the property on line and then put an offer in which has now expired, then you are 100% allowed to go to another agent.

it all comes down to how one agent was the cause of the sale, a viewing would be that cause. Online is not...

in your next OTP just make your offer expire in 48 hours max! And please ask the agent for a follow-up <-- eg. have you submitted my OTP? end of that day "any news?" etc etc
 
So in short, I am buying another property, and sadly, this transaction is going day by day, worse and worse!

My first 2 rules I broke, and now its a mess

Rule 1 : Dont use an estate agent
Rule 2 : Select the property attorney's to do the transfer!

The seller uses an estate agent though, not the buyer. Or do you mean only buy a property through a private sale that doesn't involve the seller using an agent?
