I was referring to the sales of illegal software, not legitimate software.

Also, HUP is the exception to the rule when it comes to buying end user licenses, as so many pre-requisites have to be in place. VL with SA is quite a rare thing these days when SPLA is so much cheaper.

Bearing in mind as a MS Business Partner and VAR, working with the biggest EMEA distributors, my knowledge on O364, SPLA and VL is extensive.

Also note all these places selling illegal licenses here on MyBB, is under review from Monday onward.

Aaaaghhh, have now been referring all people I know to eBay, BoB and Amazon to purchase any MS product license at next to nothing. No need to pay thousands and thousands of Rands when you can buy keys for US$5-US$19 for any MS Office product. These companies allow these sales, so they are obviously not illegal. Have already helped many businesses to become legal with these keys on sale on these platforms at very low costs.

Apparently not. Some sellers on eBay have been selling keys for many, many years and they sold them in the tens of thousands. MS does not take any actions. eBay does not either. So, not sure about it being illegal.
 
It is not legal to sell OEM keys without it being installed on hardware.

OEM software is software that comes pre-installed when you purchase a new computer.

Again, OEM software usage is ruled by the Microsoft Software Licence Terms document.

But that there are no transfer rights, so the software may not be removed from the PC it was originally installed on and installed on another, however, you are allowed to transfer the PC complete with the OEM licensed software to a new user if required.

So does that mean @Flashgear / Nucleus Tech is unethical and what they do is illegal?

It is illegal. It states it in all MS documentation and agreements. The people on eBay get away with it for various reasons.

in this case you bought this license from ebay, yes There’s possibility the license key is legal and can be activated, but the way you obtained the license is illegal by microsoft term. Such OEM license should be obtained with new hardware (complete unit or minimum Processor+Mainboard) It can supported by an Invoices which declares the purchasing of the hardware is attached by an OEM licences . If you buy OEM license separate with the hardware (separate invoices) , then your license is NOT Valid . If you buy a retail license (aka: retail license key) then you should have original retail box with license number attached to the box.

Does eBay allow selling product keys? Yes, eBay allow selling product keys and has a policy digitally delivered goods. Here is some of the policy requirements that is relevant to the listing in this question’s link section:
  1. When selling digital products, the seller must states in the listing that they own or are authorized to sell the digital content. When looking at the listing, the seller violated this part of the policy. The seller didn’t state that they owned the content and they didn’t said that they don’t own the content.   3. Software product keys are allowed to sell on eBay for digital delivery. However, if the product keys are malware or malicious content that is designed to damage someone’s computer, it is against eBay’s policy.
The conclusion is that product keys sold by unauthorized sellers can be both be valid or invalid, but the validity of the key depends on the timing of when the consumer buys the key. If the consumer buys it at the right time, the key will be valid. If eBay allows listings that violate their policies, it means that users haven’t reported the listing or that moderators haven’t seen the listing yet.

In order to sell a serial/product key on ebay it has to be attached to the product it pertains to, however in certain cases sellers can get away with selling the key with a product that is defective merely to satisfy the regulations, after all the buyer is purchasing the key/serial number.

It is not unusual, for instance, to find someone selling a Software key on a bad hard drive, because the hard drive contains, was said to contain, or at one time did contain said software. Technically the key can't be used on the software the hard drive contains (since the hard drive does not in fact work) however the seller has met the requirements ebay has set, and ultimately the buyer has access to the key/serial number itself.

In some cases it has even been known the seller to hawk a key/serial number on a ram / memory stick... How in the world would such a key/serial number ever be used on said piece of hardware is beyond me, but again it satisfies the ebay requirements and that is all the seller was accomplishing.


You should not, as a buyer purchasing such a key/serial number, expect to get a working whatever comes with it... Chances are the seller was only after the transfer of the key/serial number and is not in fact selling the software/hardware in any kind of working order, so long the key/serial number is valid.


I can go on and on but the TL:DR brigade is probably already frothing at the mouth.
 
If you work, you can use your work email to get Microsoft Office. I pay normally R150. Every time I change jobs I get another licence. Only crap is linked to 1 pc. So currently only have 1

AFAIK home use program is a software assurance benefit available through volume licensing agreements such as Open value and Enterprise Subscriptions. Plus, as ekske1 mentioned it does need to be activated by the employer.

Pretty sure also that Office Professional Plus is only available via volume agreements so any Pro Plus licenses offered via Bid or Buy would be suspect. Office Professional (I'm not up to date on MS retail licensing these days) was always available retail/DSP license but that wouldn't be suitable for certain requirements such as Office for a remote desktop environment.
 
To determine whether you have a retail edition or a volume license edition for Office 2019 and 2016, use one of the following methods, depending on which version of Microsoft Office product you have installed.
Select Command Prompt (Admin)
  1. Type the following command to navigate to the Office folder.
    For 32-bit (x86) Office
    cd c:\Program Files (x86)\Microsoft Office\Office16\
    For 64-bit (x64) Office
    cd c:\Program Files\Microsoft Office\Office16\
  2. Type the following command, and then press Enter:
    cscript OSPP.VBS /dstatus
A report will follow and if it displays "Retail type license", you good to go... but If you have a volume license (VL) product, the license type is displayed as "VL or Volume Licensing"....then not so much!

I have just activated my Office 2019 Pro Plus, that I bought from Bid or Buy, and checked the registration type, it is a "Retail Channel"
The activation took about a hour : I could not do it online so I phoned the local Microsoft number which is linked to the States...the line was very bad so they phoned me back and we activated a remote session, a lady called Sofia entered the necessary info on my computer and activated it .... I love Microsoft!

You can just type it in one command using "&&":

The ones I had bought off Amaon in the UK all show up as "Retail Channel"
