When do I complain?

If a person believes that the content of an advertisement is untruthful, misleading or harmful in any way, a complaint may be lodged.

Are there any criteria for a complaint?

All complaints lodged with the ASA must meet the following criteria:

* The complaint must be in writing.

* The identity of the complainant(s) must be disclosed.

* The contact details of the complainant(s) should be clearly stated.

* The grounds on which the complaint is based must be clearly stated.

* Where the complaint relates to advertising on broadcast media (e.g. television, radio or on cinema) information should be furnished on where and when the advertisement was screened / transmitted.

* Where signs, posters or any form of outdoor advertising is involved, the nature of the advertisement and the wording should be specified.

* When the complaint is about print advertising, the relevant advertisement should be attached.

* If possible, the contact name, address or telephone / fax number of the advertiser should be provided.

Complaints may be submitted as follows:

* By delivery, to the ASA at Willowview, Burnside Island Office Park, 410 Jan Smuts Avenue, Craighall Park, Johannesburg;

* By post to, PO Box 41555, Craighall, 2024;

* By telefacsimile, to +27 11 781 1616; or

Responsibility for establishing receipt by the ASA of a complaint lies with the complainant.

Are there any costs?

Consumer complaints will be dealt with free of charge.

i recommend everyone here emails carteblanche with whats happening, the more emails they recieve the more interested they will get
 
Surely if ICASA issued the licence to WBS, they should be contacted...

I just tried calling ICASA, guess what the guys busy on the phone with someone else.
Just mention you want to file complaint against WBS. They'll direct you to loads of numbers

As you may be aware, WBS launched their iBurst product this month. There have been several issues that were not present during the pre-launch phase, the most obvious being that of limited bandwidth.
As an iBurst user since December 2004, I can vouch for the potential speed of the product, but I have seen none of this since April 1st. However, various other users have had full speed throughout the month – even after their allotted 3 gigabytes of bandwidth had been used. WBS have tried various solutions, including buying more bandwidth from IS, and slowing all users during the day.

As of this morning, WBS committed their most heinous action to date. They have suspended all users that have used more than 6GB of data (uploading and downloading combined, local and international) this month, labelling them as abusive. The contract that users sign states that after the allotted bandwidth has been used, they will be throttled to 64kb/s for the remainder of the month, unless the user buys more bandwidth.

Nowhere in the contract does it state that WBS may suspend users for using too much bandwidth. I suspect that WBS has taken on more customer than their current system can handle, and now wishes to use the more active users as an excuse for slow access. This is ridiculous. I have personally not used all my bandwidth, as my speed has been slow all month, but I am outraged at the audacity of WBS, who obviously think they can shut us off as they please! Suspended users were told that they could buy more bandwidth, after which their connection would once again be unlimited – and not cut off after the extra bandwidth had been used.

I would appreciate Carte Blanche looking into this, as this is surely not how businesses are expected to behave. Perhaps your clout would make WBS look at themselves a little closer, and treating their customers with a little respect, instead of the sheep they think we are.

i wrote an email to them, it goes a little something like:
To Whom It May Concern,

My name is Warren Smith, due to the worsening broadband situation in this country I decided to use WBS’ mobile broadband solution instead of ADSL. Like many customers I was lured by the promise of 1mbit speeds (the fastest thus far in South Africa) as well as the ability to still access the internet at anytime after the cap is reached (the default is 3GB).

This morning (20 April 2005) at 4AM I was disconnected, I couldn’t reconnect at all. After phoning the help desk at WBS twice I finally learned my account was suspended due to “excessive usage”, I asked how could there be excessive usage, the contract I signed says I can download at 1mbit until I reach the 3GB limit and thereafter will be able to download 24/7 if I chose to at 64kbit (similar speeds to dial up) I got no answer. I then asked how can I rectify this problem and was told I would have to purchase more bandwith, this is extortion and totally goes against the contract I signed and product description seen in advertisements and on their website (www.iburst.co.za).

It seems the problem is that they promised to throttle users to 64kbit but couldn’t for some reason and now anyone that used more than 6GB during the month has had their account suspended until they pay for more bandwith, also any bandwith they do purchase must be used up by the 30th of April or they lose it. As group of frustrated users we are at a dead end, we cannot get hold of anyone high up at WBS and most won’t consider legal action because of the time and money needed to pursue the matter, so our only option is to get word out about WBS’ extortionist business tactics and hope someone bites. Most users will end up paying the money to WBS and never say another word about it and others will cancel but next month WBS could break the agreement again.

They also seem to be labeling those users suspended as “power users” and “abusers” going as far as to blame their network problems on these users however just last month a user could download 250GB and the network was fine but this month if you download anything over 6GB you are an “abuser” and the reason for their problems (even though people still have problems with the service today after all the accounts were suspended). Regardless of where they draw the line of what a “power user” is the fact is simple, they broke their contract with users and proceed to extort money out of consumers. I think its important to mention at no point was any user warned or told how much they may download while throttled and accounts were suspended without any warning.

Word your complaints differently so they see its not just one user using multiple email accounts
 
Make sure that you mention that this is not the service that you saw advertised. The advertised product was 3Gb and then 64K throttled.
