I'm being sued - yay Outsurance incompetence.

I lent my mother my car, she wrote it off. Outsurance agreed to pay out and did. However now that i've been payed the salvage yard is threatening to sue me for storage space in use.

Surely if i've signed the car over to Outsurance and they've paid me off for it then its their problem - they're storing it - not me, but no, i'm now being taken to court by the salvage yard they used, for storage fee's. Outsurance says they will call me back then they don't. I've called 3x now and no call back or response from them other than that this shouldn't of happened.

That however doesn't help me when I have attorneys damaging my credit record in the process. What recourse do I have?

Stop cutting out the middle man and you will have someone to hold accountable...
 
Out of interest, was it Outsurance that had the vehicle towed to them? Or did you let the first tow truck take the vehicle.

There will most likely be a clause in your contract that you have to arrange with Outsurance for towing, else you're liable for costs.

You are technically still in posession of the vehicle, and have not actually handed the vehicle over to Outsurance, unless Outsurance expressly instructed you to store the vehicle there.
It would be in your best interests to immediately hand that vehicle over to Outsurance, I recommend having it towed to one of their public offices.

Please ensure that somebody at the Outsurance office signs for the vehicle, you may want to take along a camera crew to record any refusal on the part of Outsurance to accept their vehicle.
 
Vehicle was taken to their storage yard as PER THEIR request.

I sent the CHANGE OF OWNERSHIP as PER THEIR request.

They PAID OUT on the claim.

I no longer have the vehicle, the vehicle is not in my name its in theirs due to change of ownership. I have already been paid. I fail to see why i'm being sued for storage space when this whole thing has nothing to do with me.

I'm not in the possession of the vehicle. They own it due to change of ownership and have since the beginning of this month! I'm being sued for storage space after it was handed over...

Ignore them & refer their queries/mail/emails to Outsurance!
 
The insurance should pay if they instructed it be towed to the storage yard. Nothing to do with you.

Once they've paid out, the vehicle belongs to them (even if title hasn't been transferred yet). It's not your problem that they haven't done anything with it. Refer the salvage yard to the owner (i.e. Outsurance).

So you suggest yelling at a broker who ultimately wont take responsibility instead? all a broker might do is fight it on your behalf until it gets too difficult at which point they give up and tell you to contact the insurer directly.
 
absolutely. It will help if you could then provide me with the relevant claim / or policy number.
 
I think the lawyer thing is probably scare tactics to get money out of you, once you paid it you'll have trouble getting it back.

I'm not giving them a dime, if they continue with this legal action then I will counter it with the likes of hellopeter , a domain similar to theirs etc. They will lose way more. I'll also take my other vehicle off their cover and my brothers vehicle which I house I was going to put that on their books, but no way now.

Geeze, I will have to cancel my contract with them.

No, just been on HelloPeter and see they have stacks of compliments. So will stay there.
There must be a misunderstanding.
