South Africa’s acting police chief is threatening to quit after being ordered by Police Minister Nathi Mthethwa to lift the suspension of corruption-implicated crime intelligence boss Richard Mdluli.

A “devastated” Lieutenant-General Nhlanhla Mkhwanazi, the acting national commissioner, is waiting to attend a meeting with President Jacob Zuma, where he is expected to discuss vacating his job.

Sources close to this week’s dramatic reinstatement of Mdluli and Major General Solly Lazarus, the controversial head of finance at crime intelligence, have told City Press that Mkhwanazi was shocked at the level of political interference in the case.

“Nobody knows what will happen next. People are frightened. What will happen to those who investigated Mdluli?” said a senior police source.

Mkhwanazi was committed to cleaning up crime intelligence, which has been embroiled in a scandal over the abuse of a R200 million secret “slush fund”.

City Press can also reveal that:
» Mdluli was not only reinstated to his old job, but was given the Presidential Protection Unit and the Protection and Security Services Unit. These units control the protection of Zuma and his ministers;

» This in effect gives Mdluli access to and control over the movements of all members of Zuma’s Cabinet, including those who will oppose his candidacy at the ANC’s national conference in December; and

» A showdown looms in the National Prosecuting Authority (NPA) between prosecutors in charge of Mdluli’s case and senior NPA bosses, who again have refused to prosecute Mdluli.

Mkhwanazi declined to comment on whether he was told by Mthethwa to reinstate Mdluli and if he would stay on in the police.

City Press revealed last week that the Inspector General of Intelligence, Advocate Faith Radebe, had advised Mkhwanazi in a letter to reinstate charges of fraud and corruption against Mdluli.

This had massive aftershocks, all pointing to a concerted effort by senior politicians close to Zuma to protect Mdluli and get him back into the police.

Informed sources in the police, NPA and justice cluster told City Press:
» Shortly after writing to Mkhwanazi that criminal charges against Mdluli should be reinstated, Radebe was put under “massive pressure” by “senior ministers” to withdraw her letter;

» Radebe “was traumatised to the point of crying”;

» Mkhwanazi refused to hand back the letter, telling Radebe she had acted in accordance with the law and they had to do “the right thing”;

» On Tuesday, Mthethwa called Radebe and Mkhwanazi to a meeting at which he ordered Mkhwanazi to lift Mdluli’s suspension and told Radebe to withdraw her letter;

» Radebe, under tremendous political pressure, told Mthethwa she had requested Mkhwanazi to give back the letter after receiving a call from “number one” (presumably a reference to Zuma), but he refused; and

» Mkhwanazi told Mthethwa he would not lift Mdluli’s suspension and would rather resign than be forced to do so.

Mthethwa told Mkhwanazi that he didn’t appoint him – Zuma did – and that only the president could accept his resignation. Zuma was in India this week attending a Brics summit.

Mkhwanazi, under protest, proceeded to lift the suspensions of Mdluli and Lazarus, but insisted that his name should not be associated with the decision.

On Wednesday, a day after the meeting with Mthethwa, the police released a terse statement saying “a decision was taken to lift the suspension of Mdluli and Lazarus concurrently”. The statement did not say who took the decision.

Yesterday, Mthethwa’s spokesperson, Zweli Mnisi, denied the minister instructed Mkhwanazi to reinstate Mdluli and Lazarus, saying he didn’t suspend them in the first place and “police management”, led by Mkhwanazi, handled departmental processes.

He confirmed that Mthethwa met the “entire management of the police” on Tuesday to discuss “policing matters”.

Zuma’s spokesperson, Mac Maharaj, on Friday vehemently denied any involvement by the president in getting Mdluli back into the police and said Zuma never called Radebe.

NPA spokesperson Mthunzi Mhaga yesterday confirmed that Advocate Lawrence Mrwebi, head of the Specialised Commercial Crimes Unit, would not prosecute Mdluli for fraud, even though Radebe advised him to do so.

This could place Mrwebi on a collision course with advocates Sibongile Mzinyathi, director of public prosecutions for North Gauteng, and Glynnis Breytenbach, head of the Specialised Commercial Crimes Unit in North Gauteng, who apparently believed that they had a rock-solid case and that charges against Mdluli should be reinstated.

“Advocate Mrwebi has already made his decision on the matter and we indicated that he considered insufficiency of evidence that would sustain a conviction in conjunction with representations made by
Mdluli’s legal representatives,” Mhaga said.

Mrwebi again advised the police to refer the matter to Radebe’s office, even though she had already said she did not have the powers to investigate Mdluli’s alleged criminality.

Johannesburg - The security wall around his property may explain why Police Minister Nathi Mthethwa is determined to shut down a Hawks investigation into a crime intelligence “slush fund”.

City Press can reveal the Hawks were investigating damaging claims that almost R200 000 for renovations to Mthethwa’s house in KwaMbonambi, northern KwaZulu-Natal, was paid out of the “slush fund” when the probe was shut down.

The Hawks also uncovered that Mthethwa drove a luxury Mercedes-Benz SUV, bought by crime intelligence, during a period of 15 months.

This is contained in a top-secret police report that was handed to acting police chief Lieutenant General Nhlanhla Mkhwanazi last month, which names Mthethwa in the Hawks’ investigation into the plundering of the R200 million secret service account.

Mthethwa denies benefiting from the secret fund or driving the vehicle, saying Mercedes-Benz is not his “favourite brand”.

City Press spoke to seven police and National Prosecuting Authority (NPA) sources with knowledge of the minister’s alleged involvement in the “slush fund” probe, some of whom had insights into the secret report.

Misuse of state vehicles

Last month we revealed that crime intelligence boss Lieutenant General Richard Mdluli was deeply implicated in the looting of crime intelligence through the alleged misuse of state vehicles, safe houses and a police travel agency.

Despite the Inspector General of Intelligence recommending that fraud charges relating to the purchase of private BMWs for him and his wife be reinstated, Mdluli’s suspension from the police was lifted last week and he is back on the job.

Mthethwa was instrumental in the reinstatement of Mdluli and the finance head of crime intelligence, Major General Solly Lazarus, against the will of Mkhwanazi, who was contemplating his future in the police.

Mkhwanazi declined to be interviewed this week, but police sources said he was still “fuming” about Mthethwa’s interference.

Questions are now being asked about the minister’s motives for doing so. Sources told City Press they were convinced Mthethwa was desperately trying to “save his own skin”.

Implicated

“That’s why he’s pushing this thing (the investigation into crime intelligence) down. He knows (that he is implicated),” said one police source.

Another said: “The squashing of the Hawks investigation is coming straight from the minister. If investigations continue, he will also be exposed as a beneficiary of crime intelligence.”

According to the police report, extensive “security renovations” were done at the private residence of Mthethwa in KwaMbonambi after Mdluli conducted a risk assessment in May 2010.

This week City Press visited Mthethwa’s house in an area known as KwaMthethwa on the outskirts of KwaMbonambi. The area falls under the tribal authority. Local residents said it was Mthethwa’s family home.

The house is located along a dirt road – far from the closest neighbours, who live over a hill.

Paid out of secret fund

The huge white wall is made from what seems to be concrete blocks and is plastered, but not painted. It surrounds a main house and several smaller buildings.

Between 14 September 2010 and January 31 last year, three amounts totalling R195 581.45 were paid out of the crime intelligence secret fund for Mthethwa’s renovations.

The report notes it is not clear whether Mthethwa knew where the money came from.

These payments, approved by Lazarus, were illegal as the secret fund can only be utilised to finance secret covert crime intelligence operations.

Security renovations at the homes of Cabinet ministers are done by the department of public works and have to be declared to Parliament.

Renovations

The report to Mkhwanazi also reveals that Hawks investigators found evidence that shows Mthethwa used a Mercedes-Benz SUV, bought in 2010 in Umhlanga with crime intelligence secret funds, between March 2010 and June last year.

The same vehicle was used by Lazarus and was later driven to Cape Town for Mdluli’s use whenever he visited the city. In total, Mthethwa, Mdluli and Lazarus drove 5 600km in the car.

The report describes how investigators from the Hawks found copies of the claims relating to Mthethwa’s renovations in the safe of a senior crime intelligence officer.

The officer claimed Lazarus ordered him to make copies of the claim after an apparent fallout between suspended police chief Bheki Cele and Mthethwa.

The Mail & Guardian reported this week that the Inspector General of Intelligence, Advocate Faith Radebe, recommended on March 6 that Mdluli’s suspension be lifted, but not Lazarus’s.

Mthethwa told Talk Radio 702 this week that Radebe ordered the police to reinstate both.

During an interview with host Redi Tlhabi, Mthethwa barely referred to Radebe’s subsequent letter to the police, dated 19 March, which recommended that Mdluli should face criminal charges for fraud.

With the amount of money stolen/used illegally and the "parties" these guys throw, they could have built way more housing. Someone should make a nice small report of the total amounts over the past 10 years alone (that we know of) and compare it to how many houses it could have built and then do a flyer drop in the townships/settlements.
 
How many of the ANC voting public actually know what is going on inside the the ANC? As much as we all know these people are corrupt, the voting masses do not and that is just one of the problems we have. The ANC voting public are so loyal to the party that they are blind to the fact that there are other parties out there and the other parties are not vocal enough in exposing the corruption within the ANC so much so that the voting public actually take their votes somewhere else thereby showing the ruling party that their time is up.

The ANC has it's own coded language when it speaks. The answers to questions come out on such a way that you feel they answered your question with a positive answer but after they have left the studio you think to yourself WTF did he/she just say?

It seems the majority of voters does not care that the current goverment are corrupt. They are either a) not well informed about the going ons or b) just dont care because maybe this is standard practice for them to be corrupt or c) they hope to get more houses / washing machines if they keep on voting.

Disclaimer: I am not a racist. By "them" and "they" I am referring to everyone who votes for the current government, whether you are white, pink, purple or green.

I only sometimes listen to Cape Talk/702 so missed this one but aren't all these politicians dodgy to say the least? What gets to me is you have some politician that stands up only after he has crossed the floor or has left politics, saying this was wrong or that was wrong, why not open your flippin mouth when you were in power dammit??
 
You should have heard the minister on the Redi Tlhabi show, it was like she was talking to a brick

Don't insult a bricks intelligence!

I think it is up to Joe Public to spread the knowledge of this corruption as the usual channels don't seem to hit the correct places!
