Pretoria - A 37-year-old man told the North Gauteng High Court on Tuesday that he had taken part in the violent murder and robbery of an elderly World War II fighter pilot.

He said he was living on the streets, and was "desperate for an income".

Judge Cynthia Pretorius found Albert Mothiba guilty of murdering Monument Park pensioner Frans Swemmer, 89, and robbing him of his car, cellphone and household goods.

Mothiba, who pleaded guilty to the charges, was earlier sent for mental observation but was found fit to stand trial.

His co-accused David Maluleka pleaded not guilty to the charges. Maluleka's trial was separated from Mothiba's and was postponed to 25 September.

Swemmer, who survived World War II and the Korean War as a fighter pilot for the South African Air Force, was found in a pool of blood in his house after apparently being dragged there from his garage.

His girlfriend and a neighbour found his body the next day after the neighbour repeatedly phoned a security company because she was worried that Swemmer's garage was open. His car was not there, but the neighbour was told that nothing was amiss.

Desperate

Mothiba said in a statement he knew Maluleka was a robber and had agreed to help him with a "job" because he basically lived on the street and was desperate for some form of income.

He said it was Maluleka's idea to go to Swemmer's house, but they left after Maluleka took beer and wine out of the garage, as Swemmer was not home.

They went to a park to drink, where they were joined by a third man, Pascal Maremane.

Maluleka and Maremane left, but returned after a while and told him that Swemmer had returned home.

Maluleka suggested that they should return to the house.

He appeared to know Swemmer, because he said the owner had a lot of money in the house.

Mothiba said he waited outside the house while the other two men went in. After a while, Maluleka came out of the garage. He had a hammer in his hand and his clothes were smeared with blood.

Maluleka opened the gate for him and when he went into the garage, he saw the elderly homeowner lying next to the car in a pool of blood.

Assaulted with a hammer

Maremane was assaulting the man with a hammer and he could see that the man was seriously injured.

According to Mothiba, Maluleka invited him to kick the victim, whereupon he kicked Swemmer twice in the chest.

The other two then pulled Swemmer into the house before they ransacked the house.

Mothiba admitted that he had taken part in the robbery knowing that the owner could be killed and had reconciled himself to what the others did, although he did not take part in the initial assault on Swemmer.

He said he had foreseen that kicking Swemmer could hasten his death and he had accepted that the elderly victim was already dying at that stage.

Mothiba was arrested in Hammanskraal while driving Swemmer's car.

He made a full confession and also pointed out Maluleka to the police.

He told the court he was willing to testify against Maluleka.

Mothiba's trial was postponed to 29 May for sentencing proceedings.
 
I wish people who are in bad enough situation like this would rather kill themselves rather than killing someone else.
 
I honestly read this article and thought it was tragic.

Tragic because Mothiba obviously had a heavy guilty conscious to confess, he kicked Swemmer because the others told him to but he didn't do the actual murder.
Everyone can sit at home and judge a hungry man for his action but I can promise that if the majority of people were in his shoes they would also reach for desperate measures, not to say that the majority would murder.
It's also tragic because we have a helpless old man who served not only South Africa, but the world and Korea through WW2 and the Korean War only to meet a violent end.

Poverty is a terrible thing.
 
If you are hungry and homeless and decide to turn to crime you still don't have to kill!

Also hungry my @ss - they first took booze!

I wish him the worst of times in jail and I hope he never gets out alive!

You dont murder people if you're poor.

But when I look at this country now, I just see the moral decay everywhere. Everyone wants to get rich quick & not happy to work for their money anymore.

Everything must be free & if someone does not want to give you his/her belongings for free......just kill them.

I tell you now these savages enjoy killing, raping & torturing people. There is no need for it but they do it and it happens on a daily basis. This is not normal crime where someone steals something and that's that, no they have to behave worse than anything else in the animal kingdom.

True, it's even to the point where they risk the consequences of a murder charge for no apparent reason. Their monetary compensation is a joke too. Criminals will spend that kind of money as quickly as anyone.

Funny ....... I found myself on the streets for a stint in my youth (the whole family) and living in a car for a few months with no dosh and relying on catching fish to eat and not once was murder or robbery brought up. Must be a culture thing huh :rolleyes:

My 75 year old next door neighbour was tied up, pistol whipped and assaulted by his gardener who came to ask for food. When my neighbour turned around to go to the kitchen he was attacked.

You can never trust the bastards...

I don't think that is fair at all. There are those who steal and murder out of desperation, then there are those out of that desperation who steal and murder because they do enjoy it.
There was no need to kill that old man, and in the article Albert Mothiba didn't kill the man, he kicked him. Disgusting? Yes, but is it as bad as murder? No. And even then he did it because Maluleka "invited" him to.

The man who killed him is Maluleka, he is the one who stole the booze and he is the one who came out of the house bloodied, yet he got off.

Albert Mothiba to me is tragic because he confessed, even though he didn't do the killing himself, he came out. What does this mean? It means in the shred of humanity he has, he felt guilty. He was an accomplice in a crime that got an elderly man killed.

I wouldn't either. But why judge the guy? Maybe he had huge families to feed? Maybe his entire life he lived through poverty. Black families are significantly larger meaning more mouths to feed. If you had a dying son and no money, would you consider stealing? Maybe you can only have an answer when you are in their shoes.

He confessed. He is going to jail, he is going to pay his dues to society and also willing to testify against the actual murderer.

You would not get away with that ina first world society like here, and let's face it that is one of the things that saffers 'miss' when they come here. "oh, how I miss my maid/gardener/hand-langer....I have no time to walk my dog".

I recall when I once needed a person to help me doing some renovations in SA in 80's. Found a young guy looking for work at lights, quick 'interview' of skills and reasons and we started at 7:30am. At 9am my wife called us for breakfast- bacon and eggs and rolls, juice etc. He first assumed he was not getting any, then when I said he was he stood outside with his hands held open. I said to him to come sit at table, and we enjoyed our breaky and worked happily the rest of day (ah lunch somewher as well). We had some chats about why he left school in Std 9, him playing rugby at school etc and I dropped him as close as safely possible to his Kayelitsha home.

He helped me from time to time over the next couple of years until I left and then on one of my trips back in 90's I ran into him in city, he was working, had gone to finish school etc, and he gave me the biggest hug.

What do you think he would have done had I treated him like an 'animal' when he worked for me?...in fact worse than animals because most people's dogs eat inside the house.

We should not make judgements on people's morality and education based on our upbringing. Role models and values, norms and morals are hard do drill into kids in an environment of squalour and poverty, so why not try to have an impact on those you meet and work for you rather than treat them like animals, and then expect them to look on your life kindly.

In the first world societies rich people who do murder hire a hit man if their money is threatened and they do white collar crime and become even richer.

God, post of the decade. Much respect to you sir who can clearly see the larger picture of things and see through the outer layer where most people stop.

Honestly, people like you give me hope, knowing there are people out there who understand, who make me feel like I'm not wasting my time typing things so other people can see in a different perspective.

What a joke, now its become a justification fest for the local murders taking place. Poverty an excuse for murder? Why is the murder rate so much lower in poorer countries. Just grow a flucking pair!

Greed, hatred and inhumanity or savagery traits are the more likely excuses for the murders locally.

By the way how come South Africa is higher than Africa as a whole? Smacks you right back I would say. Does it say a lot about the population?

That's funny, then answer me this: all poor people are savages right? Or at least more savage than rich or middle income people? Because according to you, these crimes happen because these people are savages, not because their socio economic backgrounds.

And if you bother to read, I never said there weren't sick people, infact I mentioned it in this thread, more specifically when I replied to ponder.
 
Whatever dude, you have not explained the murder of the good Samaritan have you? also just explain Zimbawe for me and why the difference?
