Suspended NPA senior prosecutor Glynnis Breytenbach is not guilty on one of the 15 charges against her, her disciplinary hearing heard in Pretoria on Monday.

"There is not an iota of evidence that [Breytenbach] exerted influence on [director at Imperial Crown Trading Archie Luhlabo] indirectly through [Sishen's counsel Mike Hellens]," chairman of the disciplinary hearing Selby Mbenenge SC said.

"I do not therefore see my way clear in finding the employee guilty of misconduct on count one," he said.

In handing down his findings Mbenenge was reading only parts of the 63-page document.

A core charge against the anti-graft prosecutor includes failing to act impartially when investigating the Kumba Iron Ore/Sishen and Imperial Crown Trading mining rights issue, because of her "improper relations" with Hellens.

Other charges include "surreptitiously leaking" National Prosecuting Authority inside information to Beeld journalist Sonja Carstens, and giving her official NPA laptop to her lawyer. The NPA has also charged Breytenbach for "maligning" the organisation in the media.

Breytenbach was suspended from the NPA on April 30, 2012. She has claimed acting National Director of Public Prosecutions Nomgcobo Jiba suspended her to stop her from prosecuting former police crime intelligence boss Richard Mdluli on fraud and other charges.

In March a parallel arbitration hearing at the Public Service Bargaining Council, in Centurion, found Breytenbach's suspension was both procedurally and substantively fair.

Her lawyer Gerhard Wagenaar said taking the arbitration hearing decision on review or appeal was still being considered.

Awesome news this. Congratulations to Glynnis Breytenbach. Get back into the NPA now and kick the asses of those miscreants and criminals out there!

To the NPA, this is just another new low in the long list of many.

Se must NOT resign. Instead she should insist that several other people who pointed fingers at her be investigated themselves!
 
They said on the radio now that she is keen if allowed to start working on the cases she was busy with when she was suspended.

Which I suspect is what they were trying desperately to avoid.
